Ordinance No. 2,1397180 ORDINANCE NO. 2139 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, PROVIDING THAT THAT PORTION OF WHITING STREET FROM AMERICAN AVENUE TO THE SOUTHERN PACIFIC RAILROAD RIGHT -OF -WAY BE VACATED, ABANDONED AND CLOSED; PROVIDING FOR THE QUITCLAIMING OF PART OF THE CITY'S INTEREST IN SAID LAND; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, Lee College is the sole user of Whiting Street from American Street to the Southern Pacific Railroad right- of -way and a public need for such street no longer exists; and WHEREAS, Lee College is the abutting land owner to that portion of Whiting Street and has made application that same be discontinued, closed, and abandoned as a public street; and WHEREAS, it appears that Lee College is a publicly owned tax exempt educational institution within the scope and intent of Resolution No. 11 establishing a procedure for abandonment of streets; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That that portion of Whiting Street from American Avenue south to the Southern Pacific Railroad right -of -way is hereby closed, abandoned and permanently vacated as a street or public thoroughfare of any kind or character whatever. Section 2: That the interest or interests of the City and /or public in the above described portion of said street (and as shown in Exhibit "A" attached hereto) is hereby quitclaimed to the adjacent owner save and except that easement reserved for the electric utilities, without con- sideration. 7181 Section 3: That the Mayor and City Clerk are hereby authorized to execute such instruments, if any, necessary for such abandonment. Section 4: That this ordinance is to become effective from and after its passage by the City Council of the City of Baytown.
