ORDINANCE NO. 2121
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, ACCEPTING THE BID OF CHANNEL CONSTRUCTION COMPANY,
INC., FOR THE SLIPLINING OF SANITARY SEWER LINES ON BOB
SMITH ROAD AND McPHAIL STREET AND AUTHORIZING THE
CONTRACTING OF INDEBTEDNESS BY THE CITY FOR THE SUM OF
NINETY -SEVEN THOUSAND NINE HUNDRED AND N01100 ($97,900.00)
DOLLARS WITH REGARD TO SUCH AGREEMENT.
WHEREAS, the City Council of the City of Baytown,
Texas, did authorize the City Engineers to advertise for
bids for the sliplining of sanitary sewer lines on Bob Smith
Road and McPhail Street to be received November 9, 1976; and
WHEREAS, notice to bidders as to the time and place,
when and where the contract for said construction would be
let was published pursuant to provisions of Vernon's Civil
Statutes, Article 2368a; and
WHEREAS, all bids were opened and publicly read at City
Hall at 10:00 o'clock a.m., Tuesday, November 9, 1976, as
per published notice to bidders; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN:
Section 1: That the City Council of the City of Baytown,
Texas, hereby accepts the bid of Channel Construction Company,
Inc., according to the plans and specifications set forth by
the City Engineers on a construction timetable of 120 working
days for the sum of Ninety -Seven Thousand Nine Hundred and
No /100 ($97,900.00) Dollars, and the Mayor and City Clerk
of the City are hereby authorized and directed to execute
and attest to a contract with Channel Construction Company,
Inc. for the sliplining of said sanitary sewer lines, containing
the plans, specifications, and requirements of the City
Engineers and appropriate bond and drawn provisions in
accordance with the provisions of Vernon's Civil Statutes,
Article 5160.

Section 2: That, pursuant to the provisions of Article
2368a, Section 2a, Vernon's Annotated Texas Statutes, the
City Manager is hereby granted general authority to approve
any change order involving a decrease or an increase in
costs of Five Thousand and No /100 ($5,000.00) Dollars or
less, subject to the proviso that the original contract
price may not be increased by more than twenty -five (2570)
percent or decreased by more than twenty -five (25%) percent
without the consent of the contractor to such decrease.
Section 3: This ordinance shall take effect from and
after its passage by the City Council of the City of Baytown.
