Ordinance No. 2,1037097 ORDINANCE NO. 2103 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING THE ABANDONMENT OF A 0.21 -ACRE TRACT OF LAND AND A WATER LINE EASEMENT HERETOFORE GRANTED TO HARRIS COUNTY WATER CONTROL AND IMPROVEMENT DISTRICT NO. 7 BY HUMBLE OIL & REFINING COMPANY; AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE SUCH INSTRUMENTS AS ARE NECESSARY FOR SUCH ABANDONMENT, IF ANY; AND PROVIDING FOR AN EFFECTIVE DATE HEREOF. WHEREAS, Humble Oil & Refining Company heretofore on the 23rd day of July, 1946, conveyed to Harris County Water Control Improvement District No. 7 a 0.21 -acre tract of land for use as a water well site together with right of way and easement for a water line, said conveyance was filed for record under Film Code No. 1380631 of the Deed Records, Harris County, Texas; and WHEREAS, said conveyance was conditioned upon said tract of land and water line easement reverting to Humble Oil & Refining Company upon abandonment by the District of said tract and said easement; and WHEREAS, upon annexation of the aforementioned property the City of Baytown assumed operation of the District's well and water line; and WHEREAS, said well and water line are no longer needed by the City, and the City Council of the City of Baytown, Texas, wishes to formally abondon same; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: 7098 Section 1: That the City Council of the City of Baytown does hereby abandon any and all interest in and to the following described tract of land: The 0.21 -acre tract of land herein described is located in the William Scott Upper League in Harris County, Texas, being out of or across a tract of land known as Humble Fee No. 2752 now owned by the Humble Oil & Refining Company. 0.21 -Acre Tract Beginning at the most westerly corner of the 0.86 -acre tract of land which was conveyed to Mutual Benefit Association by Humble Oil & Refining Company in deed dated April 26, 1937, of record in Volume 1052, page 199, of the Deed Records of Harris County, Texas, said point being the point of beginning of the 0.21 - acre tract of land herein described. Thence N. 530 00' E., along the northwest line of aforesaid 0.86 -acre M.B.A. tract, 120.00' to a point; Thence N. 370 00' W., 78.00' to a point; Thence S. 530 00' W., 120.00' to a point; Thence S. 370 00' E., 78.00' to the point of beginning, containing 0.21 acres of land more or less. Section 2: That the City Council of the City of Baytown does hereby abandon any and all interest in and to the following described right of way and easement: Beginning at the most westerly corner of the 0.86 -acre tract of land which was conveyed to Mutual Benefit Association by Humble Oil & Refining Company in the aforesaid deed dated April 26, 1937; Thence N. 370 00' W., 73.00' to a point, said point being the point of beginning of the line easement herein described; Thence S. 530 00' W., 128.00' to a point, said point being the point of ending of line easement herein described; Section 3: That the Mayor and City Clerk are hereby authorized to execute and attest to such instruments as are necessary for such abandonment, if any. -2- 7099 Section 4: This ordinance is to become effective from and after its passage by the City Council of the City of Baytown, Texas.
