Ordinance No. 2,0967076 ORDINANCE NO. 2096 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ACCEPTING THE BID OF R. T. BISHOP CONSTRUCTION CO., INC. & R. T. BISHOP, A JOINT VENTURE FOR THE CONSTRUCTION OF A SANITARY SEWER LINE ON HUNNICUTT STREET, CONTRACT NO. 76 -10 AND AUTHORIZING THE CONTRAC- TING OF INDEBTEDNESS BY THE CITY FOR THE SUM OF THIRTY - SIX THOUSAND EIGHT HUNDRED NINETY -SIX AND N01100 ($36,896.00) DOLLARS WITH REGARD TO SUCH AGREEMENT. WHEREAS, the City Council of the City of Baytown, Texas, did authorize the City Engineer of the City of Baytown to advertise for bids for the construction of a sanitary sewer line on Hunnicutt Street to be received Tuesday, October 5, 1976; and WHEREAS, notice to bidders as to the time and place, when and where the contract for said construction would be let was published pursuant to provisions of Vernon's Civil Statutes, Article 2368a; and WHEREAS, all bids were opened and publicly read at City Hall at 10:00 o'clock as per published notice to bidders; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the City Council of the City of Baytown, Texas, hereby accepts the bid of R. T. Bishop Construction Co., Inc. & R. T. Bishop, a joint venture, according to the plans and specifications set forth by the Consulting Engineers on a construction timetable of 90 working days for the sum of Thirty -Six Thousand Eight Hundred Ninety -Six and No /100 ($36,896.00) Dollars, and the Mayor and City Clerk of the City are hereby authorized and directed to execute and attest to a contract with R. T. Bishop Construction Co., Inc. & R. T. Bishop, a joint venture, for the construction of 7077 said sanitary sewer containing the plans, specifications, and requirements of the Consulting Engineers and appropriate bond and drawn provisions in accordance with the provisions of Vernon's Civil Statutes, Article 5160. Section 2: That, pursuant to the provisions of Article 2368a, Section 2 a, Vernon's Annotated Texas Statutes, the City manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of Five Thousand and N01100 ($5,000.00) Dollars or less, subject to the proviso that the origninal contract price may not be increased by more than twenty -.five (25 10 percent or decreased by more than twenty -five (257) percent without the consent of the contractor to such decrease. Section 3: This ordinance shall take effect from and after its passage by the City Council of the City of Baytown.
