AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, AMENDING CHAPTER 12, "FIRE PREVENTION AND PROTEC-
TION," ARTICLE IV, FIRE LANE EASEMENTS, SECTION 12 -47,
REQUIREMENTS OF FIRE LANE EASEMENTS, BY REPEALING
SUBSECTION (a) AS PRESENTLY CONSTITUTED AND SUBSTITUT-
ING IN ITS PLACE A NEW SUBSECTION (a); PROVIDING A
REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND
PROVIDING FOR THE EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS:
Section 1: That the Code of Ordinances of the City of
Baytown, Texas, is hereby amended by amending Chapter 12,
"Fire Prevention and Protection," Article IV, Fire Lane
Easements, Section 12 -47, Requirements of Fire Lane Easements,
by repealing subsection (a) thereof, as it presently exists
and substituting in its place a new subsection (a) which
shall read as follows, to wit:
Sec. 12 -47. Requirements of fire lane easements.
(a) All structures shall be located so as to be within
three hundred (300) feet of a dedicated, accessible, and
improved public street or within one hundred fifty (150)
feet of a dedicated, accessible, and improved fire lane
easement. No dwelling unit of a residential building shall
be located more than three hundred (300) feet from a func-
tioning fire hydrant.

Section 3: Savings Clause: If any provision, exception,
section, subsection, paragraph, sentence, clause or phrase
of this ordinance or the application of same to any person
or set of circumstances shall for any reason be held uncon-
stitutional, void or invalid, such invalidity shall not
affect the validity of the remaining provisions of this
ordinance or their application to other persons or sets of
circumstances and to this end, all provisions of this
ordinance are declared to be severable.
Section 4: Effective Date: This ordinance shall take
effect from and after its passage by the City Council of the
City of Baytown,
