ORDINANCE NO.2082
AN ORDINANCE OFTHE CITY COUNCIL OFTHECITYOF BAYTOWN,
TEXAS,AMENDING CHAPTER 28£,"TAXATION,"BY REPEALING
SUBSECTION 28J.l(b)AS PRESENTLY CONSTITUTED AND SUB
STITUTING IN ITS PLACE THE PROVISIONS OF A NEW SUBSECTION
28£.l(b);REPEALING ORDINANCES INCONSISTENT HEREWITH;
CONTAINING A SAVINGS CLAUSE;AND PROVIDING FORTHE
EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THECITY COUNCIL OF THE CITY OF
BAYTOWN,TEXAS:
Section 1:That the Code of Ordinances of the City of
Baytown is hereby amended by the amendment of Chapter 28§,
"Taxation,"by repealing Subsection 28£.l(b)thereof,and
the same shall cease to have force and effectfrom and after
the effective date of this ordinance.
Section 2:That the Code of Ordinances is hereby
amended by adding thereto the provisions of a new Subsection
28£.l(b)which shall read as follows,towit:
Section 28^.1.Exceptions to payment of ad valorem
taxes.
(b)Subject tothe provisions hereof,from and
after January 1,1975,$5,000 of the assessed value of
residence homesteads,as defined by the laws of the
State of Texas,of married or unmarried persons sixty-
five (65)years of age or older,including those living
alone shall be exempted from ad valorem taxes levied by
the City of Baytown.
Section 3:Repealing Clause:All ordinances or parts
of ordinances inconsistent with the terms of this ordinance
are hereby repealed;provided,however,that such repeal
shall be only to the extent of such inconsistency and in all
other respects this ordinance shall be cumulative of other
ordinances regulating and governing the subject matter
covered by this ordinance.

Section 4:Savings Clause:If any provision,section,
exception,subsection,paragraph,sentence,clause or phrase
of this ordinance or the application of same to any person
or set of circumstances,shall for any reason be held uncon
stitutional,void or invalid,such invalidity shall not
affect the validity of the remaining provisions of this
ordinance or their application to other persons or sets of
circumstances and to this end all provisions of this ordinance
are declared to be severable.
Section 5:Effective Date:This ordinance shall take
effect from andafter its passage by the City Council of the
City of Baytown.
