Ordinance No. 2,0806989 ORDINANCE NO.2080 AN ORDINANCE OFTHECITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,ACCEPTING THEBID OF CHANNEL CONSTRUCTION COMPANY, INC.,FORTHE SLIPLINING OF SANITARY SEWER LINESON NORTH BURNETT DRIVE,FOURTH STREET,SEVENTH STREET AND FAYLE STREET;AND AUTHORIZING THE CONTRACTING OF INDEBT EDNESS BY THE CITY FOR THESUM OF SIXTY-SEVEN THOUSAND FOUR HUNDRED FIFTY AND NO/100 ($67,450.00)DOLLARS WITH REGARD TO SUCH AGREEMENT. WHEREAS,the City Council of the City of Baytown, Texas,did authorize the administration to advertise for bids forthe sliplining of sanitary sewerlines on North Burnett Drive,Fourth Street,Seventh Street and Fayle Street to be received September 7,1976;and WHEREAS,notice to bidders as to the time and place, when and where the contract for said construction would be let was published pursuant to provisions of Vernon's Civil Statutes,Article 2368a;and WHEREAS,all bids were opened and publicly read at City Hall at 10:30 a.m.,Tuesday,September 7,1976,as per published notice to bidders;NOW THEREFORE, BE IT ORDAINED BY THECITY COUNCIL OF THE CITY OF _BAYTOWN: Section 1:That the City Council of the City of Baytown, Texas,hereby accepts the bid of Channel Construction Company, Inc.,according to the plans and specifications set forth by the administration on a construction timetable of 100 working days for thesum of Sixty-Seven Thousand Four Hundred Fifty and No/100 ($67,450.00)Dollars,andthe Mayor andCity Clerk of the City are hereby authorized and directed to execute and attest toa contract with Channel Construction Company,Inc.for the sliplining of said sanitary sewer lines,containing the plans,specifications,and requirements 6990 T of the administration and appropriate bond and drawn provisions in accordance with the provisions of Vernon's Civil Statutes, Article 5160. Section 2:That,pursuant to the provisions of Article 2368a,Section 2a,Vernon's Annotated Texas Statutes,the City Manager is hereby granted general authority to approve any changeorder involving a decrease oran increase in costs of Five Thousand and No/100 ($5,000.00)Dollars or less,subject to the proviso that the original contract price may not be increased by more th.-n twenty-five (25%) —^percent or decreased by more than twenty-five (25%)percent without the consent of the contractor to such decrease. Section 3:This ordinance shall take effect from and after its passage by the City Council of the City of Baytown.
