ORDINANCE NO.2068
AN ORDINANCE OF THE CITY COUNCIL OFTHE CITY OF BAYTOWN,
TEXAS,APPROVING AND ACCEPTING THE RECHANNELIZATION OF
THOMAS CIRCLE BY BROWN &ROOT,INC.;FINDING THAT THE
CONSTRUCTION IS IN ACCORDANCE WITH THE TERMS OF THE
CONTRACT;ACCEPTING THE ENGINEERS'CERTIFICATE OF FINAL
ACCEPTANCE;AUTHORIZING THE FINAL PAYMENT TO THE SAID
BROWN &ROOT,INC.AND PROVIDING FOR THE EFFECTIVE DATE
HEREOF.
WHEREAS,the City of Baytown contracted with Brown&
Root,Inc.for the rechannelization of Thomas Circle;and
WHEREAS,all of the said construction,as provided for
in the plans and specifications heretofore prepared by the
Consulting Engineers,and as approved and adopted by the
City Council,has been performed and completed in full
accordance with all of the terms and provisions of the
aforesaid contract;and
WHEREAS,the Consulting Engineers in the manner pro
vided by the terms of the said contract andthe plans and
specifications thereof,have approved and accepted said
construction and have heretofore issued their Certificate of
Final Acceptance,and have certified same to the City Council
and recommended that it accept and receive said work as
constructed and completed by the said Brown &Root,Inc.;
and
WHEREAS,there remains and owing to the said contractor
thesum of Twenty-Seven Thousand Nine Hundred Sixty-Six and
80/100 ($27,966.80)Dollars,thesum of One Hundred Twenty-
Nine Thousand Nine Hundred Nineteen and 50/100 ($129,919.50)
Dollars heretofore advanced to contractor in partial payments
under the provisions of the said contract;NOW THEREFORE,

BE IT ORDAINED BYTHECITY COUNCIL OFTHECITY OF
BAYTOWN,TEXAS:
Section 1:That theCity Council hereby approves and
accepts said rechannelization of Thomas Circle,and determines
that all of said work has been completed as provided in the
plans and specifications therefore,and in full accordance
with all of the terms and provisions of the aforesaid contract,
Section 2:That the Certificate of Final Acceptance
heretofore issued by the Consulting Engineers and certified
to the City Council is hereby accepted and received.
Section 3:That final payment to the said Brown&
Root,Inc.in the amount of Twenty-Seven Thousand Nine
Hundred Sixty-Six and 80/100 ($27,966.80)Dollars is hereby
authorized and directed.
Section 4:This ordinance shall take effect from and
after its passage by the City Council of the City of Baytown,
Texas.
INTRODUCED,READ and PASSED by the affirmative vote of
the City Council of the City of Baytown this 12th day of
August,1976.

The City Council of the City of Baytown,Texas,convened
in regular meeting,open to the public,on the 26th day of
August,1976,at the City Hall,andthe roll was called of
the duly constituted officers and members of the City Council
and the City Clerk of the City,to-wit:

Emmett Hutto Councilman

and all ofsaid persons were present,except the following ab
sentees:none ,
thus constituting a quorum.Whereupon,among other business,
the following was transacted at said meeting:a written ordi
nance entitled:
ORDINANCE AUTHORIZING ISSUANCE OF $1,250,000
WATERWORKS AND SANITARY SEWER SYSTEM REVENUE BONDS,
SERIES 1976;APPROPRIATING $500,000 OF PROCEEDS OF SALE
THEREOF FORTHE PURPOSE OF IMPROVING AND EXTENDING THE
CITY'S SANITARY SEWER SYSTEM;AND CONTAINING OTHER
PROVISIONS RELATING THERETO
(the "Ordinance")wasduly introduced for the consideration of
the City Council and reviewed in full.It was then duly moved
and seconded that the Ordinance be passed;and,after duedis
cussion,the motion,carrying with it the passage of the Ordi-
nance,prevailed and carried by the following vote:
AYES:All members of the City Council shown
present above voted "Aye".
NOES:None.
The Mayor thereupon announced thatthe Ordinance had been duly
and lawfully adopted.The Ordinance thus adopted follows:
