ORDINANCE NO.2061
AN ORDINANCE AMENDING THECODE OF ORDINANCES OF THE
CITY OF BAYTOWN,TEXAS,BY THE AMENDMENT OF CHAPTER 31,
"UTILITIES,"BY THE ADDITION OF NEW SUBSECTIONS (b)AND
(c);PROVIDING FOR SEWER TAP PERMITS;PROVIDING FOR A
MAXIMUM PENALTY OF TWO HUNDRED ($200.00)DOLLARS;
PROVIDING A REPEALING CLAUSE;CONTAINING A SAVINGS
CLAUSE;AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE
DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN,TEXAS:
Section 1:That Chapter 31,"Utilities,"of theCode
of Ordinances of theCity of Baytown,Texas,is hereby
amended bythe addition of new subsections (b)and (c),
which shall read as follows,to-wit:

UTILITIES
ARTICLE V.SEWER SERVICE
Sec.31-67.Sewer tapping fees.
(b)The owner may,at his option and expense,have any
four (4")inch sewer tap made by a licensed master plumber.
A sewer tap permit shall be obtained by application with the
Plumbing Inspector.No fee will be charged by the City for
such a sewer tap.The sewer tap is subject to inspection by
the Plumbing Inspector and must be constructed according to
the city engineers'specifications for sewer taps.
(c)Any person who taps a sewer line without a permit or
in violation of the terms of this section shall be deemed
guilty of a misdemeanor and shall be punished by a fine of
not more than Two Hundred ($200.00)Dollars.
Section 2:Repealing Clause:All ordinances or parts
of ordinances inconsistent with the terms of this ordinance
are herebyrepealed;provided,however,that such repeal
shall be only to the extent of such inconsistency and in all
other respects this ordinance shall be cumulative of other
ordinances regulating and governing thesubject matter
covered by this ordinance.

Section 3:Savings Clause:If any provision,section,
exception,subsection,paragraph,sentence,clause or phrase
of this ordinance or the application of same to any person
or set of circumstances,shall for any reason be held uncon
stitutional,void orinvalid,such invalidity shall not
affect the validity of the remaining provisions of this
ordinance of their application to other persons or sets of
circumstances and to this end all provisions of this ordi
nance are declared to beseverable.
Section 4:Effective Date:This ordinance shall take
effect from and after ten (10)days after its passage by the
City Council.The City Clerk is hereby directed to give
notice hereof by causing the caption of this ordinance to be
published in the official newspaper of the City of Baytown
at least twice within ten (10)days after its passage.
