Ordinance No. 2,0546869 ORDINANCE NO.2054 AN ORDINANCE OF THECITY COUNCIL OF THECITYOF BAYTOWN, TEXAS,AMENDING CHAPTER 18,"MOTOR VEHICLES ANDTRAFFIC," ARTICLE IV,SPEED REGULATIONS,SECTION 18-98.1,DESIGNATION OF SPEED LIMIT ZONES,BY REPEALING SUBSECTION (2)OF SECTION (C),40 MILE PER HOUR SPEED ZONES,AND THE SAME SHALL CEASE TO HAVE FORCEAND EFFECT;AND BY REPEALING SUBSECTION (5)OF SECTION (E),50 MILE PER HOUR SPEED ZONES,AS PRESENTLY CONSTITUTED AND SUBSTITUTING IN ITS PLACE A NEW SUBSECTION (5);PROVIDING FOR A MAXIMUM PENALTY OF TWO HUNDRED ($200.00)DOLLARS;PROVIDING A REPEALING CLAUSE;CONTAINING A SAVINGS CLAUSE;AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. BE IT ORDAINED BYTHE CITY COUNCIL OFTHECITY OF BAYTOWN,TEXAS: Section 1:That the Code of Ordinances of the City of Baytown,Texas,is hereby amended by amending Chapter 18, "Motor Vehicles and Traffic,"Article IV,Speed Regulations, Section 18-98.1,Designation of Speed Limit Zones,Section (c)40 mile per hour speed zones,by repealing subsection (2)thereof,as it presently exists andthe same shall cease to have force and effect from and after the effective date of this ordinance. Section 2:That the Code of Ordinances of the City of Baytown,Texas,is hereby amended by amending Chapter 18, "Motor Vehicles and Traffic,"Article IV,Speed Regulations, Section 18-98.1,Designation of Speed Limit Zones,Section (e)50 mile per hour speed zones,by repealing subsection (5)thereof,as it presently exists and substituting in its place a new Section (e)(5)which shall read as follows,to- wit: Sec.18-98.1.Designation of speed limit zones, (e)50 mile per hour speed zones: (5)Loop 201 From Highway No.146 to Decker Drive 6870 Section 3:Repealing Clause:All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed;provided however,that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 4:Savings Clause:If any provision, exception,section,subsection,paragraph,sentence,clause or phrase of this ordinance or the application of same to any person or set of circumstances shall for any reason be held unconstitutional,void or invalid,such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end,all provisions of this ordinance are declared to beseverable. Section 5:Penalty Clause:Any person violating the provisions of this ordinance shall be punished by a fine of not more thanTwo Hundred ($200.00)Dollars,and each violation shall constitute a separate offense. Section 6:Effective Date:This ordinance shall take effect from and after ten (10)days after its passage by the City Council.TheCity Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10)days after its passage. -2- 6871 INTRODUCED,READ and PASSED by the affirmative vote of the City Council of the City of Baytown,on this 22nd day of July >1976.
