AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS,ACCEPTING THE BID OF D.R.SMART SAND COMPANY
FORTHE PURCHASE OF ESTIMATED QUANTITIES OF TOPSOIL FOR
THE BEAUTIFICATION OFSTATE HIGHWAY 146 ON A UNIT PRICE
BASIS,WITH THE COMPENSATION TO BE PAID TO BE BASED
UPON THE ACTUAL QUANTITIES SUPPLIED AND PROVIDING FOR
THE EFFECTIVE DATE HEREOF.
WHEREAS,the City Council of the City of Baytown,
Texas,did authorize the Purchasing Department for the City
of Baytown to advertise for bids for the purchase of estimated
quantities of topsoil for the beautification of State Highway
146 on a unit price basis to be received June 16,1976;and
WHEREAS,notice to bidders asto the time and place,
when and where the contract would be let was published
pursuant to provisions of Section 74of the Charter of the
City of Baytown;and
WHEREAS,all bids were opened and publicly read at City
Hall at 8:30 a.m.,Wednesday,June 16,1976,as per pub
lished notice to bidders;NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN:
Section 1:That the City Council of the City of Baytown,
Texas,hereby accepts the bid of D.R.Smart Sand Company
for the purchase of topsoil for the beautification of State
Highway 146 in accordance with the invitation to bid and
specifications of the City of Baytown as follows:

1,400 cu.yd.Topsoil $3.90 $5,460.00
with the compensation tobe paid to be based upon theactual
quantities supplied.

Section 2:This ordinance shall take effect immediately
from and after its passage by the City Council of the City
of Baytown,Texas.
INTRODUCED,READ and PASSED by the affirmative vote of
the City Council on this 24th day of June ,
