AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE
CITY OF BAYTOWN,TEXAS,BY THE AMENDMENT OF CHAPTER 17,
MISCELLANEOUS PROVISIONS AND OFFENSES,BY ADDING THERE
TO NEW SECTIONS DESIGNATED SECTIONS 17-19 and 17-20,
REGULATING THE DISPLAY OF SECURITY COMPANIES'NAME AND
UNIFORMS ANDTHEUSE OF EMERGENCY LIGHTS OR SIRENS;
CONTAINING DEFINITIONS;PROVIDING A PENALTY;PROVIDING
A SAVINGS CLAUSE;AND PROVIDING FOR THE PUBLICATION AND
THE EFFECTIVE DATE HEREOF.
WHEREAS,various individuals may,pursuant to state
statute,operate security service agency or provide security
services in the City of Baytown;and
WHEREAS,the City Council believes that it would be in
the best interest of the citizens of the City of Baytown to
minimize confusion between these security service agencies
and the police of the City of Baytown;NOW THEREFORE,
BEIT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN,TEXAS:
Section 1:Any person who engages in the business of,
or performs any service as,a guard company,alarm systems
company,courier company or security services contractor or
offers his services in such capacities or engages in such
business shall have the company name of such security service
printed on each side of any and all vehicles used by said
company,said printing to be in letters six (6")inches in
height,and approved by the Chief of Police.No vehicles
used in such security services shall be equipped with emer
gency lightsor siren.
Section 2:Any and all officers,employees,and agents
of any such person who engages in security services,while
on duty,shall wear uniforms approved by the City Manager
and Chief of Police but theywill in no way resemble the
uniform of the Baytown Police Department.
Section 3:Any person who shall violate the provision
of paragraph (a)or (b)of this section shall be deemed
guilty of a misdemeanor and,upon conviction,shall be fined
in a sum not exceeding Two Hundred and No/100 ($200.00)
Dollars for such offense,and each day that paragraphs (a)
or (b)are violated shall constitute a separate offense and
be punished separately;andany person,engaged in violation
shall,on conviction,be so punished therefor.
Section 4:If any provision,exception,section,
subsection,paragraph,sentence,clause or phrase of this
ordinance or the application of same to any person or actof
circumstances,shall for any reason be held unconstitutional,
void orinvalid,such invalidity shall not affect the valid
ity of the remaining provisions of this ordinance or their
application to other persons or sets of circumstance and to
this end all provisions of this ordinance are declared to be
severable.
Section 5:This ordinance shall take effect from and
after ten (10)days after its passage by theCity Council.
The City Clerk is hereby directed to give notice hereof by
causing the caption of this ordinance to be published in the
official newspaper of the City of Baytown at least twice
within ten (10)days after its passage.
