ORDINANCE NO.2010
AN ORDINANCE OF THECITY COUNCIL OFTHE CITY OF BAYTOWN,
TEXAS,ACCEPTING THE BID OF M°KEY CONSTRUCTION AND
EQUIPMENT RENTAL COMPANY FOR THE CONSTRUCTION OF THE
JAIL HOUSE DITCH AREA DRAINAGE IMPROVEMENTS AND AUTHORIZING
THE CONTRACTING OF INDEBTEDNESS BY THE CITYFORTHE SUM
OFTHREE HUNDRED SEVEN THOUSAND THREE HUNDRED FORTY-TWO
AND30/100($307,342.30)DOLLARS WITH REGARD TO SUCH
AGREEMENT.
WHEREAS,the City Council of the City of Baytown,
Texas,did authorize Busch,Hutchison &Associates,Inc.,
Consulting Engineers to the City of Baytown,to advertise
for bids for the construction of the jail house ditch area
drainage improvements tobe received Tuesday,May 18,1976;
and
WHEREAS,notice to bidders as to the time and place,
when and where the contract for said construction would be
let was published pursuant to provisions of Vernon's Civil
Statutes,Article 2368a;and
WHEREAS,all bidswere opened and publicly read at City
Hall at 10:15 o'clock a.m.,as per published notice to
bidders;NOW THEREFORE,
BE IT ORDAINED BY THECITY COUNCIL OF THE CITY OF
BAYTOWN:
Section 1:That the City Council of the City of Baytown,
Texas,hereby accepts the bid of McKey Construction and
Equipment Rental Company according to the plans and speci
fications set forth by the Consulting Engineers on a con
struction timetable of 140 working days forthesum Three
Hundred Seven Thousand Three Hundred Forty-Two and 30/100
$307,342.30)Dollars,and the Mayor and City Clerk of the
City are hereby authorized and directed to execute and
attest to a contract with McKey Construction and Equipment

Rental Company for the construction of said drainage improve
ments containing the plans,specifications,and requirements
of the Consulting Engineers and appropriate bond and drawn
provisions in accordance with the provisions of Vernon Civil
Statutes,Article 5160.
Section 2:That,pursuant to the provisions of Article
2368a,Section 2a,Vernon's Annotated Texas Statutes,the
City Manager is hereby granted general authority to approve
any change order involving a decrease oran increase in
costs of Five Thousand and No/100 ($5,000.00)Dollars or
less,subject to the proviso that the original contract
pricemay not be increased by more than twenty-five (25%)
percent or decreased by more than twenty-five (25%)percent
without the consent of the contractor to such decrease.
Section 3:This ordinance shall take effect from and
after its passage by the City Council of the City of Baytown.
