AN ORDINANCE OF THE CITY COUNCIL OF THECITY OF BAYTOWN,
TEXAS,ACCEPTING THE BID OF R.T.BISHOP CONSTRUCTION
COMPANY FOR THE CONSTRUCTION OF EAST HUNNICUTT DRAINAGE
IMPROVEMENTS AND AUTHORIZING THE CONTRACTING OF INDEBT
EDNESS BY THE CITY FOR THESUMOFFIVE HUNDRED TWENTY
THOUSAND THREE HUNDRED NINETY-SIX AND NO/100 ($520,396.00)
DOLLARS WITH REGARD TO SUCH AGREEMENT.
WHEREAS,the CityCouncil of the City of Baytown,
Texas,did authorize Busch,Hutchison &Associates,Inc.,
Consulting Engineers to the City of Baytown,to advertise
for bids for the construction of East Hunnicutt drainage
improvements to be received Tuesday,May 18,1976;and
WHEREAS,notice to bidders as to the time and place,
when and where the contract for said construction would be
let was published pursuant to provisions of Vernon's Civil
Statutes,Article 2368a;and
WHEREAS,all bids were opened and publicly read at City
Hall at 10:00 o'clock a.m.,as per published notice to
bidders;NOW THEREFORE,
BE IT ORDAINED BYTHE CITY COUNCIL OF THE CITY OF
BAYTOWN:
Section 1:Thatthe City Council of the City of Baytown,
Texas,hereby accepts the bid of R.T.Bishop Construction
Company according to the plans and specifications set forth
by the Consulting Engineers on a construction timetable of
140 working days forthe sum of Five Hundred TwentyThousand
Three Hundred Ninety-Six and No/100 ($520,396.00)Dollars,
and the Mayor and City Clerk of the City are hereby authorized
and directed to execute and attest to a contractwith R.T.
Bishop Construction Company for the construction of said
drainage improvements containing the plans,specifications,
and requirements of the Consulting Engineers and appropriate
bond and drawn provisions in accordance with the provisions
of Vernon Civil Statutes,Article 5160.
Section 2:That,pursuant to the provisions of Article
2368a,Section 2a,Vernon's Annotated Texas Statutes,the
City Manager is hereby granted general authority to approve
any change order involving a decrease or an increase in
costs of Five Thousand and No/100 ($5,000.00)Dollars or
less,subject to the proviso that the original contract
price may not be increased by more than twenty-five (25%)
percent or decreased by more than twenty-five (25%)percent
without the consent of the contractor to such decrease.
Section 3:This ordinance shall take effect fromand
after its passage by the City Council of the City of Baytown,
INTRODUCED,READ and PASSED by the affirmative vote of
the City Council on this 27th day of May ,1976.
