AN ORDINANCE AMENDING THECODEOF ORDINANCES OF THE
CITYOF BAYTOWN,TEXAS,BY AMENDING CHAPTER 11—"ELEC
TRICAL CODE,"ARTICLE III,PERMITS AND INSPECTION,
SECTION 11-49 THEREOF,SOAS TO REPEAL THE PROVISIONS
THEREOF AS PRESENTLY CONSTITUTED AND TOSUBSTITUTE IN
ITS PLACE A NEW SECTION 11-49;AND BY THE AMENDMENT OF
ARTICLE IV,TECHNICAL REQUIREMENTS,SECTION 11-73,BY
THE ADDITION OF A NEWNUMBER (22);PROVIDING FOR A
PENALTY;PROVIDING A REPEALING CLAUSE;AND PROVIDING
FOR THE PUBLICATION ANDTHE EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN,TEXAS:
Section 1:That the Code of Ordinances of the City of
Baytown,Texas,is hereby amended by amending Chapter 11—
"Electrical Code,"Article III,Permits and Inspection,by
repealing Section 11-49,Application,as it presently exists
and the same shall cease to have force and effect from and
after the effective date of this ordinance.
Section 2:That the Code of Ordinances of the City of
Baytown,is hereby amended by the amendment of Chapter 11—
"ElectricalCode,"by adding new provisions relating to
application in Section 11-49,which shall read as follows,
towit:
The application for a permit shall describe the
work to be done and shall be made in writing by a
person holding the proper electrician's license or
an electrical sign contractor's license.
The permit,when issued,shall be issued to such
applicant to cover such work as described and
detailed.Any change or additions must be covered
by additional permits at the time changes are
made.
The application shall be accompanied by such
plans,specifications and schedules as may be
necessary to determine whether or notthe instal
lation,as described,will be in conformity with
the requirements of this chapter.No such plans,
specifications and schedules will be examined
under the provisions of this chapter unlessthe
same are submitted bythe holder of the proper
electrician's license or electrical sign contrac
tor's license orby a homeowner.
A precise detailed print of the routing ofall
underground feeders shall be furnished to the
electrical inspector and the owner of the premises
before the electrical permit is issued for the
job.
Ifit is found that the installation as described
will be in general conformity to the requirements
of this chapter,and if the applicant has complied
with the provisions of this chapter,a permit for
such installation shall be issued;provided,
however,that the issuance of a permit will not be
taken as permission or as a license to violateany
of the requirements of this section or any other
ordinance of the city.
Section 3:That the Code of Ordinances of the City of
Baytown,is hereby amended by amending Chapter 11—"Electrical
Code,"Article IV,Technical Requirements,Section 11-73,
Requirements Enumerated,bythe addition of a newnumber
(22)thereto,which shall read as follows,to wit:
(22)All underground feeders for commercial and
multi-occupancy buildings be in conduit and
covered with a minimum of 2"red concrete at
a depth specified by the National Electrical
Code.
Section 4:Repealing Clause:All ordinances or parts
of ordinances inconsistent with the terms of this ordinance
are hereby repealed;provided,however,that such repeal
shall be only to the extent of such inconsistency and in all
other respects this ordinance shall be cumulative of other
ordinances regulating and governing the subject matter
covered by this ordinance.
Section 5:Savings Clause:If any provision,section,
exception,subsection,paragraph,sentence,clause or phrase
of this ordinance or the application of same to any person
or set of circumstances,shall for any reason be held uncon
stitutional,void or invalid,such invalidity shall not
affect the validity of the remaining provisions of this

ordinance of their application to other persons or sets of
circumstances and to this end all provisions of this ordinance
are declared tobe severable.
Section 6:Any person violating the provisions of this
ordinance shall be punished by a fine of not more than Two
Hundred ($200.00)Dollars,and each violation shall consti
tute a separate offense.
Section 7:Effective Date:This ordinance shall take
effect from and after ten (10)days after its passage by the
City Council.The City Clerk is hereby directed to give
noticehereof by causing the caption of this ordinance to be
published in the official newspaper of the City of Baytown
at least twice within ten (10)days after its passage.
