Ordinance No. 1,9841 ORDINANCE NO.1984 AN ORDINANCE OFTHE CITY COUNCIL OFTHE CITY OF BAYTOWN, TEXAS,AUTHORIZING THE EXCHANGE OF LAND OWNED BY THE CITYOF BAYTOWN FOR LAND OWNED BY SAN JACINTO METHODIST HOSPITAL;DIRECTING THE MAYOR TO EXECUTE AND THE CITY CLERK TOATTESTTO INSTRUMENTS CONVEYING SAID LAND TO SAN JACINTO METHODIST HOSPITAL,AND PROVIDING FORTHE EFFECTIVE DATE HEREOF. WHEREAS,the City of Baytown,Texas,isin need of additional land forthe expansion of Sterling Municipal Library;and WHEREAS,the land adjacent to the library which is necessary for such expansion is presently owned by San Jacinto Methodist Hospital;and WHEREAS,in the future,San Jacinto Methodist Hospital willneed certain property owned by the City of Baytown, where West Sterling Street is presently located,in order to expand its hospital facilities;and WHEREAS,the closing of Sterling Street will not cause a loss of access to any parcel of property;and WHEREAS,the City of Baytown and San Jacinto Methodist Hospital have agreed to exchange the above referred to properties so that each will be in a position to effectuate its plans for expansion;and WHEREAS,TEX.REV.CIV.STAT.art.5421c-12 provides that narrow strips of land and streets and alleys may be sold by the City to abutting property owners without the necessity of publication of notices and taking of bids;and WHEREAS,TEX.REV.CIV.STAT.art.5421c-12 further provides that any conveyance,sale or trade made pursuant to the provisions thereof shall never be made for lessthan the fair market value of the land or interest in land being conveyed,sold or traded as determined by an appraisal, which appraisal shall be conclusive ofthe fair market value;and WHEREAS,Tax Assessor-Collector of the City of Baytown has made an appraisal of the lands and other valuable con sideration to be exchanged by the City of Baytown and San Jacinto Methodist Hospital and has determined that the fair market value of the lands and other valuable consideration to be acquired by the City of Baytown is not less than the #"*>fair market value of the land to be conveyed to San Jacinto Methodist Hospital by the City of Baytown;NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OFTHE CITY OF BAYTOWN,TEXAS: Section 1:That the City Council of the City of Baytown hereby accepts the appraisal of the Tax Assessor-Collector of the City of Baytown which is attached hereto marked Exhibit "A". Section 2:That the City Council of the City of Baytown, does hereby authorize the exchange of land owned by the City of Baytown,Texas,described in Exhibit "B,"attached hereto, for land owned by San Jacinto Methodist Hospital described in Exhibit "C,"attached hereto,and the Mayor and the City Clerk are hereby authorized to execute such instruments as are necessary to effect this exchange.This authorization is conditioned upon the City of Baytown obtaining from San. Jacinto Methodist Hospital a temporary easement for street purposes across the land which it is conveying to the said San Jacinto Methodist Hospital (thereby insuring the uninter rupted flow of traffic on Sterling Street)until such time as Price Street is relocated by San Jacinto Methodist Hospital -2- at its expense and consistent with Engineering standards for the City of Baytown's streets and upon the City of Baytown obtaining a utility easement for any utilities which might have to be relocated as a result of the closing of Sterling Street or the relocation of Price Street. Section 2:That the City of Baytown hereby authorizes the acceptance of a deed to property described in Exhibit "C,"hereto from San Jacinto Methodist Hospital in consid eration for the conveyance of the property described in Exhibit "B". The City of Baytown intends to trade property described in Appraisal No.4 for the San Jacinto Methodist Hospital properties described in Appraisal No.1 or No.2 and Appraisal No.3.The purpose is to substantiate the "Fair Market Value"ofeach of the '^parcels individually.t I havemade a personal inspection of eachof the properties and a search and analysis of the relevant data.All of the information available and pertinent to the value of each of the propertieshas been analyzed and accorded proper consideration to the best of my ability in the time made available.
