AN ORDINANCE OF THE CITY COUNCIL OF THECITYOF BAYTOWN,
TEXAS,ACCEPTING THEBID OF HI-WAY EQUIPMENT INC.FOR
THE RENTAL OF ONE HYDRAULIC EXCAVATOR FOR THESUM OF
TWO THOUSAND FOUR HUNDRED FIFTY AND NO/100 ($2,450.00)
DOLLARS PER MONTH AND PROVIDING FOR THE EFFECTIVE DATE
HEREOF.
WHEREAS,theCityCouncil of the City of Baytown,
Texas,did authorize the administration of the City of
Baytown to advertise for bids for the rental of one hydraulic
excavator to be received March 22,1976;and
WHEREAS,notice to bidders as to the time and place,
when and where the contract for said rental would be let was
published pursuant to provisions of Vernon's Civil Statutes,
Article 2368a;and
WHEREAS,all bids wereopened and publicly read at City
Hall at 10:30 o'clock a.m.,Monday,March 22,1976,as per
published notice to bidders;NOW THEREFORE,
BE IT ORDAINED BYTHECITY COUNCIL OF THE CITYOF
BAYTOWN:
Section 1:That the City Council of the City of Baytown,
Texas,hereby accepts the bid of Hi-Way Equipment Inc.for
the rental of one hydraulic excavator,according to the
specifications set forth bythe administration of the City
of Baytown for the sum of Two Thousand Four Hundred Fifty
and No/100 ($2,450.00)Dollars per month not to exceed five
(5)months with a delivery to be made between thirty (30)
and forty-five (45)calendar days from the effective date
hereof,and the Mayor and the City Clerk of the City of
Baytown are hereby authorized and directed to execute and
attest to a lease agreement withHi-Way Equipment Inc.

Section 2:This ordinance shall take effect fromand
after its passage by the City Council of theCity of Baytown
INTRODUCED,READ and PASSED by the affirmative vote of
the City Council on this 25thday of March 1976.
