Ordinance No. 1,954ORDINANCE NO.1954 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,ACCEPTING THE BID OF SPAW GLASS,INC.FOR THE EXPANSION AND REMODELING OF STERLING MUNICIPAL LIBRARY AND AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THE CITY FOR THE SUM OF FIVE HUNDREDSIXTY-TWO THOUSAND AND NO/100 ($562,000.00)DOLLARS WITH REGARD TO SUCH AGREEMENT. WHEREAS,the City Council of the City of Baytown, Texas,did authorized Davis &Burge,Consulting Architects, to the City of Baytown,to advertise for bids for the expansion and remodeling of Sterling Municipal Library;and WHEREAS,notice to bidders as to the time and place, when and where the contract for said construction would be let was published pursuant to provisions of Vernon's Civil Statutes,Article 2368a;and WHEREAS,all bids were opened and publicly read at City Hall at 4:00 p.m.,Tuesday,February 10,1976,as per published notice to bidders;NOW THEREFORE, BE IT ORDAINED BYTHE CITY COUNCIL OFTHE CITY OF BAYTOWN: Section 1:That the City Council of the City of Baytown, Texas,hereby accepts the bid of Spaw Glass,Inc.according to the plans and specifications set forth bythe Consulting Architects on a construction timetable of 225 calendar days for the sum of Five Hundred Sixty-Two Thousand and No/100 ($562,000.00)Dollars,and the Mayor and City Clerk of the City are hereby authorized and directed to execute and attest to a contract with Spaw Glass,Inc.forthe construction of said expansion and remodeling of Sterling Municipal Library containing the plans,specifications,and requirements of the Consulting Architects and appropriate bond and drawn provisions in accordance with the provisions of Vernon's Civil Statutes,Article 5160. Section 2:That,pursuant to the provisions of Article 2368a,Section 2a,Vernon's Annotated Texas Statutes,the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of Five Thousand and No/100 ($5,000.00)Dollars or less,subject to the proviso that the original contract price may not be increased by more than twenty-five (25%) percent or decreased by more than twenty-five (25%)percent without the consent of the contractor to such decrease. Section 3:This ordinance shall take effect from and after its passage by the City Council of the City of Baytown INTRODUCED,READ and PASSED by the affirmative vote of the City Council on this 26th day of February,1976.
