Ordinance No. 1,9506390 ORDINANCE NO.1950 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OFBAYTOWN, TEXAS,DESIGNATING NORTH MAIN STREET AT JAMES AVENUE AS A THROUGH INTERSECTION;DIRECTING THE CHIEF OF POLICE ANDTHE DIRECTOR OF PLANNING AND TRAFFIC TO REMOVE SIGNS DESIGNATING MANDATORY TURNING;AMENDING CHAPTER 18,"MOTOR VEHICLES AND TRAFFIC",BY THE AMENDMENT OF SECTION 18-122.2,DESIGNATION OF NO PARKING ZONES,BY THE ADDITION OF A NEW SUB-SECTION (n);PROVIDING A PENALTY FOR THE VIOLATION THEREOF,AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1:That the City Council of the City of Baytown, Texas,does hereby determine that all lanes of traffic on North Main Street at James Avenue shall be for through traffic. Section 2:The Chief of Police andthe Director of Planning and Traffic are hereby authorized and directed to remove signs requiring mandatory left turn movements. Section 3:That the Code of Ordinances of the City of Baytown,Texas,is hereby amended by the amendment of Chapter 18,"Motor Vehicles and Traffic",Section 18-122.2,Designation ofNo Parking Zones,by the addition of a new sub-section (n),which shall read as follows: (n) North Main Street,the west side,from the intersection of North Main Street and James Avenue to a point 125 feet south of said intersection. Parking of vehicles within sucharea is hereby prohibited at all times. Section 4:TheChief of Police and the Director of Planning and Traffic are authorized and directed to cause the proper signs to be posted as designated above. 6391 Section 5:It shall be unlawful for a driver of a vehicle to disobey the instruction of said signs placed in accordance with the provisions of this ordinance,unless at the time otherwise directed by a police officer. Section 6:Any person violating the provisions of this ordinance shall be punished by a fine of not more than Two Hundred ($200.00)Dollars,and each violation shall constitute a separate offense. Section 7:Repealing Clause:All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed;provided,however,that such repeal shall be only to theextent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 8:Savings Clause:If any provision,section, exception,subsection,paragraph,sentence,clause or phrase of this ordinance or the application of same toany person or set of circumstances,shall for any reason beheld unconsti tutional,void or invalid,such invalidity shall not affect the validity of the remaining provisions of this ordinance of their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared tobe severable. Section 9:Effective Date:This ordinance shall take effect from and after ten (10)days after its passage by the City Council.The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance tobe published in the official newspaper of the City of Baytown at least twice within ten (10)days after its passage. -2- 6392 INTRODUCED,READ and PASSED by the affirmative vote of the City Council of the City of Baytown on this12th day of February,1976.
