ORDINANCE NO.1944
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS,ACCEPTING THE BID OF BROWN &ROOT,INC.,FOR THE
RECHANNELIZATION OF THOMASCIRCLE AND AUTHORIZING THE
CONTRACTING OF INDEBTEDNESS BYTHE CITY FOR THESUM OF
ONE HUNDRED SIXTY-SIX THOUSAND ONE HUNDRED SEVENTY-NINE
AND NO/100 (166,179.00)DOLLARS WITH REGARD TO SUCH
AGREEMENT.
WHEREAS,the City Council of the City of Baytown,
Texas,did authorize the City's Consulting Engineers to
advertise for bids forthe rechannelization of ThomasCircle
tobe received February 3,1976;and
WHEREAS,notice to bidders as to the time and place,
when and where the contract for said construction would be
let was published pursuant to provisions of Vernon's Civil
Statutes,Article 2368a;and
WHEREAS,all bids were opened and publicly read at City
Hall at 10:00 o'clock a.m.,Tuesday,February 3,1976,as
per published notice to bidders;NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN:
Section 1:That the City Council of the City of Baytown,
Texas,hereby accepts the bid of Brown 8s Root,Inc.,according
to the plans and specifications set forth by the City's
Consulting Engineers on a construction timetable of 45
working days for the sum of One Hundred Sixty-Six Thousand
One Hundred Seventy-Nine and No/100 ($166,179.00)Dollars,
and the Mayor and City Clerk of the City are hereby authorized
and directed to execute and attest to a contract with Brown
&Root,Inc.for the rechannelization of Thomas Circle,
containing theplans,specifications,and requirements of
theCity's Consulting Engineers and appropriate bond and
drawn provisions in accordance with the provisions of Vernon's
Civil Statutes,Article 5160.

Section 2:That,pursuant to the provisions of Article
2368a,Section 2a,Vernon's Annotated Texas Statutes,the
City Manager is hereby granted general authority to approve
any change order involving a decrease or an increase in
costs of Five Thousand and No/100 ($5,000.00)Dollars or
less,subject to the proviso that the original contract
price may notbe increased by more than twenty-five (25%)
percent or decreased by more than twenty-five (25%)percent
without the consent of the contractor to such decrease.
Section 3:This ordinance shalltake effect from and
after its passage by the City Council of the City of Baytown,
INTRODUCED,READ and PASSED by the affirmative vote of
the City Council on this 12th day of February,1976.
