ORDINANCE NO.1941
AN ORDINANCE OF THECITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS,AUTHORIZINGPAYMENT BY THE CITY OF BAYTOWN TO
THE HARRIS-GALVESTON COASTAL SUBSIDENCE DISTRICT OF ITS
ESTIMATED ANNUAL GROUND WATER WITHDRAWAL FEE.
WHEREAS,the 64th Legislature in its regular session in
1975 in the enacted H.B.No.552,creating the Harris-
Galveston Coastal Subsidence District to regulate the
withdrawal of ground water for the purpose of ending subsid
ence;and
WHEREAS,by said act therewas created a Board of
Directors to govern the district with the power to adopt and
enforcerules and regulations designed to expeditiously and
effectively effectuate the provisions of the Act and accomplish
its purposes;and
WHEREAS,pursuant to this authority said Board has
adopted rules and regulations which,among other things,
provide for the assessment of annual ground water withdrawal
fees to be based upon the amount of ground water withdrawn
against all persons and entities within the district's
boundaries withdrawing ground water;and
WHEREAS,as said rules and regulations further provide
for pre-payment of the estimated fee based upon projected
withdrawals of water;and
WHEREAS,theCity of Baytown projects that its ground
water withdrawal will be 2,312,675,000 gallons,which will
represent an annual withdrawal fee of Twenty-Seven Thousand
Seven Hundred Fifty-Three and No/100 ($27,753.00)Dollars;
NOW THEREFORE,
BE IT ORDAINED BY THECITY COUNCIL OF THE CITY OF
BAYTOWN,TEXAS:

Section 1:That the City Manager is hereby authorized
and directed to pay to Harris-Galveston Coastal Subsidence
District the sum of Twenty-Seven Thousand Seven Hundred
Fifty-Three and No/100 ($27,753.00)Dollars representing its
estimated annual ground water withdrawal fee.
Section 2:This ordinance shall take effect from and
after its passage by the City Council of the City of Baytown.
