Ordinance No. 1,9406367 ORDINANCE NO.1940 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN,TEXAS,BYTHE AMENDMENT OF CHAPTER 34, "WASTE DISPOSAL,"ARTICLE II,INDUSTRIAL WASTE ORDIN ANCE,SECTION 34-31,SCHEDULE OF CHARGES,BY SPECIFYING UNIT COSTS OF TREATMENT CHARGEABLE TO B.O.D.ANDSUS PENDED SOLIDS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1:The Code of Ordinances of the City of Baytown,Texas,is hereby amended by amending Chapter 34, "Waste Disposal,"Article II,Industrial Waste Ordinance, Section 34-31,Schedule of Charges,by repealing those portions of said sectiondealing with unit cost treatment chargeable to B.O.D.(bo=unit cost of treatment chargeable to B.O.D.,$/pound)and unit cost treatment chargeable to suspended solids (so=unit cost of treatment (including sludge)chargeable to suspended solids,$/pound)as they presently exist and the same shall cease to have force and effect from and after the effective date of this ordinance. Section 2:That the Code of Ordinances of the City of Baytown,is hereby amended by the amendment of those portions of Section 34-31,Schedule of Charges,of Chapter 34,"Waste Disposal,"Article II,Industrial Waste Ordinance,relating to unit costs of treatment chargeable to B.O.D.and suspended solids,which shall read as follows: bo=unit cost of treatment chargeable to B.O.D.,which shall be $0.083/pound so=unit cost of treatment (including sludge)chargeable to suspended solids,which shall be $0.057/pound Section 3:Repealing Clause:All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed;provided however,that suchrepeal 6368 shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 4:Savings Clause:If any provision,exception, section,subsection,paragraph,sentence,clause or phrase of this ordinance or the application of same to any person or set of circumstances shall forany reason be held uncon stitutional,void or invalid,such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end,all provisions of this ordinance are declared tobe severable. Section 5:Effective Date:This ordinance shall take effect from and after ten (10)days from its adoption by the City Council of the City of Baytown,Texas.The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10)days after passage.
