ORDINANCE NO.1932
AN ORDINANCE OF THECITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS ACCEPTING THE BID OF PAYTONCONSTRUCTION COMPANY
FOR THE DEVELOPMENT OF BAYTOWN BICENTENNIAL PARK AND
AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THE CITY
FOR THE SUM OF ONE HUNDRED THIRTY THOUSAND EIGHT HUNDRED
FORTY-SEVEN AND NO/100 ($130,847.00)DOLLARS WITH
REGARD TO SUCH AGREEMENT.
WHEREAS,the City Council of the City of Baytown,
Texas,did authorize Busch,Hutchison &Associates,Inc.,
Consulting Engineers for the City of Baytown,to advertise
for bids for the development of Baytown Bicentennial Park;
and
WHEREAS,the plans,specifications and bid instructions
prepared by the Consulting Engineers provided that one
bridge,4,000 cubic yards of fill dirt,and 200 linear feet
of concrete walkway would be deductible alternates in said
bid;and
WHEREAS,notice to bidders as to thetime and place,
when and where the contract for said construction would be
let was published pursuant to provisions of Vernon's Civil
Statutes,Article 2368a;and
WHEREAS,all bids were opened and publicly read at City
Hall at 10:15 o'clock a.m.,Tuesday,December 30,1975,as
per published notice to bidders;NOW THEREFORE,
BE IT ORDAINED BYTHE CITY COUNCIL OF THE CITY OF
BAYTOWN:
Section 1:That the City Council of the City of Baytown,
Texas,hereby accepts the bid of Payton Construction Company,
excluding all deductible items,those items being one bridge,
4,000cubic yards of fill dirt and 200 linear feet of concrete
walkway,all in accordance with the plans and specifications

set forth by the Consulting Engineers,on a construction
timetable of ninety (90)working days,forthe sum of One
Hundred Thirty Thousand Eight Hundred Forty-Seven and No/100
($130,847.00)Dollars.
Section 2:The Mayor and City Clerk of the City are
hereby authorized and directed to execute and attestto a
contract with Payton Construction Company for the development
of Baytown BicentennialPark containing the plans,specifi
cations,and requirement of the Consulting Engineers and
appropriate bond and drawn provisions in accordance with the
provisions of Vernon's Civil Statutes,Article 5160.
Section 3:That,pursuant to the provisions of Article
2368a,Section 2a,Vernon's Annotated Texas Statutes,the
City Manager is hereby granted general authority to approve
any change order involving a decrease oran increase in
costs of Five Thousand and No/100 ($5,000.00)Dollars or
less,subject to the proviso that the original contract
price may not be increased by more than twenty-five (25%)
percent or decreased by more than twenty-five (25%)percent
without the consent of the contractor to such decrease.
Section 3:This ordinance shall take effect from and
after its passage by the City Council of the City of Baytown.

the City Council on this 8thday of January ,1976.
