AN ORDINANCE OF THECITY COUNCIL OF THE CITY OFBAYTOWN,
TEXAS,ACCEPTING THE BID OF FLOYD BUSBEECONSTRUCTION
COMPANY FOR THE CONSTRUCTION OF ROBIN ROADDRAINAGE
IMPROVEMENTS AND AUTHORIZING THE CONTRACTING OF IN
DEBTEDNESS BY THE CITY FOR THESUMOF ONE HUNDRED
SEVENTY-FIVE THOUSAND NINE HUNDRED TEN AND NO/100
($175,910.00)DOLLARS WITH REGARDTO SUCH AGREEMENT.
WHEREAS,the City Council of the City of Baytown,
Texas,did authorize Busch,Hutchison &Associates,Inc.,
Consulting Engineers to the City of Baytown,to advertise
for bids for the construction of RobinRoad drainage improve
ments to be received Tuesday,December 16,1975,and
WHEREAS,notice to bidders as to the time and place,
when and where the contract for said construction would be
let was published pursuant to provisions of Vernon's Civil
Statutes,Article 2368a;and
WHEREAS,all bidswere opened and publicly read at City
Hall at 10:00 o'clock a.m.,as per published notice to
bidders;NOW THEREFORE,
BE IT ORDAINED BYTHE CITY COUNCIL OFTHE CITY OF
BAYTOWN:
Section 1:That the City Council of the City of Baytown,
Texas,hereby accepts the bid of Floyd Busbee Construction
Company according tothe plans and specifications set forth
by the Consulting Engineers on a construction timetable of
90 working days forthe sum of One Hundred Seventy-Five
Thousand Nine Hundred Tenand No/100 ($175,910.00)Dollars,
andthe Mayor and City Clerk of the City are hereby authorized
and directed to execute and attest to a contract with Floyd
Busbee Construction Company for the construction of said
drainage improvements containing the plans,specifications,
and requirements of the Consulting Engineers and appropriate
bond and drawn provisions in accordance with the provisions
of Vernon's Civil Statutes,Article 5160.

Section 2:That,pursuant to the provisions of Article
2368a,Section 2a,Vernon's Annotated Texas Statutes,the
City Manager is hereby granted general authority to approve
any change order involving a decrease oran increase in
costs of Five Thousand and No/100 ($5,000.00)Dollars or
less,subject to the proviso that the original contract
price may not be increased by more than twenty-five (25%)
percent or decreased by more than twenty-five (25%)percent
without the consent of the contractor to such decrease.
Section 3:This ordinance shall take effect from and
after its passage by the City Council of the City of Baytown.
