Ordinance No. 1,9296337 ORDINANCE NO.1929 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN,TEXAS,BY THE AMENDMENT OF CHAPTER 12—FIRE PREVENTION AND PROTECTION,SECTION 12-47.1, SITE STANDARDS,BY THE ADDITION OF A SUB-SECTION (c), REPEALING ORDINANCES INCONSISTENT HEREWITH AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OFTHE CITY OF BAYTOWN,TEXAS: Section 1:That the Code of Ordinances of the City of Baytown,Texas,is hereby amended by amending Chapter 12— Fire Prevention and Protection,Section 12-47.1,Site Standards,by the addition of a sub-section (c),which shall read as follows,to-wit: (c)Controlled Income and Rent Housing may be approved upon recommendation by the Planning Commission and approval of the CityCouncil,utilizing the following criteria: (1)The sitemust be approved bythe Federal Agency responsible for financing and the contemplated project must be subject to income limitations set forth in the federal regulations. (2)Density allowances will take into consideration family sizes and age of intended occupants. (3)Parking requirements may be adjusted by the Commission to fit demonstrated demand in similar projects. Section 2:Repealing Clause:All ordinances or parts of ordinances inconsistent with the terms of this ordinance are herebyrepealed;provided,however,that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3:Savings Clause:If any provision,section, exception,subsection,paragraph,sentence,clause or phrase of this ordinance or the application of same to any person 6338 r or set of circumstances,shall forany reason be held unconstitutional,void or invalid,such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances andto this endall provisions of thisordi nance are declared to be severable. Section 4:Effective Date:This ordinance shall take effect from and after its passage by theCity Council.
