ORDINANCE NO.1925
AN ORDINANCE OF THE CITY COUNCIL OFTHE CITY OFBAYTOWN,
TEXAS,ACCEPTING THE BID OF BORING AND TUNNELING COMPANY
OF AMERICA,INC.,FOR THE CONSTRUCTION OF BAYWAY DRIVE
WATER MAINS AND AUTHORIZING THE CONTRACTING OF INDEBTED
NESS BY THE CITY OF THESUMOF TWO HUNDRED SIXTY-NINE
THOUSAND FOUR HUNDRED NINETY-EIGHT AND NO/100 ($269,498.00)
DOLLARS WITH REGARD TO SUCH AGREEMENT.
WHEREAS,the City Council of the City of Baytown,
Texas,did authorize Busch,Hutchison &Associates,Inc.,
Consulting Engineers to the City of Baytown,to advertise
for bids for the construction of Bayway Drive water mains to
be received December 2,1975;and
WHEREAS,notice to bidders asto the time and place,
when and where the contract for said construction would be
let was published pursuant to provisions of Vernon's Civil
Statutes,Article 2368a;and
WHEREAS,all bids were opened and publicly read at City
Hall at 10:00 o'clock a.m.,Tuesday,December 2,1975,as
per published notice to bidders;NOW THEREFORE,
BE IT ORDAINED BYTHECITY COUNCIL OFTHECITY OF
BAYTOWN:
Section 1:That the City Council of the City of
Baytown,Texas,hereby accepts the bid of Boring andTun
neling Company of America,Inc.,according to the plans and
specifications set forth by the Consulting Engineers for the
sum of Two Hundred Sixty-Nine Thousand Four Hundred Ninety-
Eight and No/100 ($269,498.00)Dollars,and the Mayor and
City Clerk of the City are hereby authorized and directed to
execute and attest to a contract with Boring and Tunneling
Company of America,Inc.,for the construction of Bayway

Drivewater mains,containing the plans,specifications,and
requirements of the Consulting Engineers and appropriate
bond and drawn provisions in accordance with the provisions
of Vernon's Civil Statutes,Article 5160.
Section 2:That,pursuant to the provisions of Article
2368a,Section 2a,Vernon's Annotated Texas Statutes,the
City Manager is hereby granted general authority to approve
any change order involving a decrease or an increase in
costs of Five Thousand and No/100 ($5,000.00)Dollars or
less,subject to the proviso that the original contract
price may not be increased by more than twenty-five (25%)
percent or decreased by more than twenty-five (25%)percent
without the consent of the contractor to such decrease.
Section 3:This ordinance shall take effect fromand
after its passage by the City Council of theCity of Baytown
INTRODUCED,READ and PASSED by the affirmative vote of
the City Council on this 11th day of December 1975.
