Ordinance No. 1,915629!+ ORDINANCE NO.1915 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK OF THE CITY OF BAYTOWN TO EXECUTE AND ATTEST TO A CONTRACTWITH HARRIS COUNTY WITH REGARD TO JOINT PARTICI PATION IN THE CONSTRUCTION OF THE WATER LINE ALONG BAKER ROAD AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OFTHE CITY OF BAYTOWN,TEXAS: Section 1:That theCity Council of theCity of Baytown, Texas,hereby approves the contract providing for joint participation between the City of Baytown and Harris County withregard to the replacement of the water line alongBaker Road,and authorizes and directs the Mayor and City Clerk of theCity of Baytown to execute and attest to said contract. A copy of said contract is attached hereto,marked Exhibit "A,"and made a part hereof for all intents and purposes. Section 2:This ordinance shall take effect from and after its passage by the City Council of the City of Baytown. TOM GENTRY,Mayor \/ ATTEST: EILEEN P.HALL,City Clerk APPROVED: NEEL RICHARDSON"City Attorneyr/ EXHIBIT "A" 6295 AGREEMENT BETWEEN HARRIS COUNTY AND CITY OF BAYTOWN FOR JOINT PARTICIPATION IN THE CONSTRUCTION OF WATER LINEALONG BAKER ROAD THE STATE OF TEXAS j} COUNTY OF HARRIS 0 Harris County,a body corporate and politic under the laws of the State of Texas,hereinafter sometimes called "County,"and the City of Baytown,a municipal corporation under the laws of the State of Texas,hereinafter sometimes called "Baytown,"agree as follows: 1.It is to the mutual benefit of the parties hereto that Baker Road,a public road in the City of Baytown be improved. 2.It is to the mutual benefit of the parties hereto thatthe existing water line along BakerRoad from Garth Road to the well site on Baker Road be replaced in the following manner:As per Alternate Proposal of Marathon Paving &Utility Constructors,Inc.,of November 11,1975, which proposal is based upon red lined drawings prepared by City of Baytown. 3.The estimated cost of the materials and labor for theabove mentioned improvement is One Hundred Ninety-Two Thousand Eighty-One and No/100 ($192,081.00)Dollars Baytown agrees to contribute to the cost of said improvements in an amount equal to the cost of the labor and materials,but in no event to exceed One Hundred Ninety-Two Thousand Eighty-One and No/100 ($192,081.00)Dollars. 4.Within ten (10)days afterthe execution of this agreement,Baytown will deliver to the County Treasurer its check,payable to Harris County,in the amount of One Hundred Ninety-Two Thousand Eighty-One and No/100 ($192,081.00)Dollars, said amount being the estimated cost of the materials as hereinabove referred to. 6296 5.In accordance with its usual procedure,the County will advertise for bids and purchase all the materials necessary for said improvements. 6.It is understood and agreed that the County may make such minor changes in the materials tobe used andthe work to be done as the County Engineer deems necessary or desirable during construction. 7.After completion of the improvement project,the County Auditor shall send Baytown a statement stating the total cost of the materials and labor used by the County or its contractor forthe above mentioned improvements.If the actual cost of the materials is less than the amount previ ously paid to the County by Baytown,then the County will refund to Baytown the excess of the amount Baytown paid to the County over and above the actual cost of said laborand materials.Any amount due and payable under this paragraph, shall be paid within 60 days after completion of the work or 30 days after the County Auditor prepares the above mentioned statement,whichever is sooner.
