AN ORDINANCE DETERMINING AND FIXING THE
MAXIMUM SCHEDULES OF RATES TO BE CHARGED
BY ENTEX,INC.(PREVIOUSLY NAMED UNITED
GAS,INC.),ITS SUCCESSORS AND ASSIGNS,
IN THE CITY OF BAYTOWN,TEXAS,FORNA
TURAL GAS AND NATURAL GAS SERVICE FUR
NISHED BY IT TO RESIDENTIAL AND COMMER
CIAL CONSUMERS,CONTAINING DEFINITIONS,
FIXING THE EFFECTIVE DATES OF GAS RATES
PRESCRIBED IN THIS ORDINANCE,MAKING MIS
CELLANEOUSPROVISIONS AND REPEALING ALL
ORDINANCES IN CONFLICT.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS:
SECTION 1.That Entex,Inc.(previously named United
Gas,Inc.),its successors and assigns,is hereby authorized to place
in effect the followingschedules of rates within the corporate limits
of the City of Baytown,Texas (hereinafter called "City")for the sup
ply of natural gas and natural gas service:
RESIDENTIAL RATE
APPLICATION OF SCHEDULE
This schedule is applicable to any customer to whom service is supplied
in a single private dwelling unit and its appurtenances,the majoruse
of which is for household appliances,and for the personal comfort and
convenience of those residing therein.
Natural gas supplied hereunder is for the individual use of the cus
tomer at one point of delivery and shall not be resold or shared with
others.
NET MONTHLY RATE
1.For the billing months of May through October:
$2.00 per month,which includes the use of 400 cubic feet
12.3£per 100 cubic feet for the next 2,600 cubic feet
ll.Ojzf per 100 cubic feet forthe next ■■3,000 cubic feet
4.2£per 100 cubic feet forall additional gas used.
Minimum Bill:$2.00
2.For the billing months of November through April:
$2.00 per monthwhich includes the use of 400 cubic feet
12.3£per 100 cubic feet forthe next 2,600 cubic feet
11.0*5 per 100 cubic feet forthe next 3,000 cubic feet
9.0^5 per 100 cubic feet for the next 10,000 cubic feet
5.5^per 100 cubic feet for all additional gas used.
Minimum Bill:$2.00

PAYMENT
Each monthly residential bill shall be increased by the lesser of (a)
10%of the net monthly bill or (b)$3.00,to arrive at the gross monthly
bill.The difference between the gross bill and the net bill,repre
senting a discount,shall be allowed for payment of bills within ten
(10)days after the date of the bill.If a gas bill is not paid within
ten (10)days after its date,the gross bill shall apply.
ADJUSTMENT PROVISION
The above monthly ratesshall be increased by nine and seventeen-
hundredths of one cent (9.17jz<)for each 100 cubic feet of gas consumed.
COMMERCIAL RATE
APPLICATION OF SCHEDULE
This schedule is applicable to natural gas service to any customer
engaging in any business,professional,or institutional activity,
for all uses of gas,including cooking,heating,refrigeration,water
heating,air conditioning,and power.
Natural gas supplied hereunder is for the individual use of the
customer atone point of delivery and shall not be resold or shared
with others.Gas consumption under this rate schedule is limited to
150,000 cubic feet in any month.When a customer uses in excess of
150,000 cubic feet in any month,the consumer shall be billed on the
applicable large volume rate schedule.
NET MONTHLY RATE
$2.25 per month,which includes the use of 400 cubic feet

PAYMENT

Each monthly commercial bill shall be increased by the lesser of (a)10%
of the net monthly bill or (b)$5.00,to arrive at the gross monthly

bill.The difference between the gross bill and the net bill,represent

days after the date of the bill.If a gas bill is not paid within ten

ADJUSTMENT PROVISION
The above monthly ratesshall be increased by nine and seventeenth-

SECTION 2.The above describedschedules of residential
rates and commercial rates,as adjusted in the manner therein provided,.
are the highest rates that may be charged by Entex,Inc.,its successors
and assigns,for residential consumers and commercial consumers within
the City.Other lower residential rates and commercial rates may be
fixed and determined fromtime to time by Entex,Inc.,its successors
andassigns,for gas and gas service furnished residential consumers
and commercial consumers within the City.
SECTION 3.The foregoing rates are uniform with the rates
established for Entex for its Houston Integrated Distribution System
and said ratesare based upon Entex's cost of service in its Houston
Integrated Distribution System and the value of all facilities therein
used by Entex in serving the City of Baytown and other cities,towns
and villages as well as the environs thereof,servedbysaid distribu
tion system.
The Railroad Commission of Texas,after notice and hearing
of its Docket No.573,established and fixed the rate to be paid at
the city gate for gas purchased for resale to the consumers affected
by this article.If suchcitygate rate is hereafter decreased or
increased pursuant to order of the Railroad Commission (and from
time to time as such orders may issue)the rates herein fixed shall
forthwith be likewise adjusted plus or minus to reflect any such
increases or decreases.
Whenever an increase or decrease in the foregoing rates becomes

appropriateunder the foregoing adjustment provisions,Entex,Inc.
shall promptly file with the city Clerk of Baytown,a sworn statement
setting forth the changes in the citygaterate and the resulting
adjustment of therates.Each such adjustment shall become effective
for bills rendered onor after the first day of billing month following
the month in which such statement is filed.
SECTION 4.That the maximum rates and charges prescribed
in this ordinance shallapply as maximum rates and charges for resi
dential consumersand commercial consumers on all bills rendered for
gasand forgas service after the effective date of this ordinance,
viz,the date of final passage hereof.
SECTION 5.That all ordinances or parts of ordinances in
conflictherewith are repealed to the extent ofthe conflict only.
SECTION 6.That nothing contained inthis ordinance shall
be construed asin any manner,nor or hereafter,limiting or modifying
the right and power ofthe City,under the law,to regulate the rates
charged by Entex,Inc.,its successors andassigns,within the City.
