AN ORDINANCE OFTHE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS,AUTHORIZING A CHANGE ORDER TO THE CONTRACT WITH
STAR CONCRETE CONSTRUCTION FOR THE CONSTRUCTION OF
DRAINAGE AND EARTH WORK ONTHE WEST TEXAS AVENUE PROJECT,
JOB.NO.74-563,AND PROVIDING FOR THE EFFECTIVE DATE
HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1:That the City Councildoes hereby authorize a
change order to the contract with Star Concrete Construction for
the construction of drainage and earth work on the West Texas
Avenue Project,Job No.74-563.A copy of saidchangeorder is
attached hereto,marked Exhibit "A,"and made a part hereof for
all intents and purposes.
Section 2:This ordinance shall take effect from and after
the date of its passage by the affirmative vote of the City Council
of the City of Baytown.

jority of the City Council of the City of Baytown this 23rd day
of October,1975.

CHANGES IN ELEMENTS OF CONSTRUCTION FOR WEST TEXAS AVENUE
This will confirm our discussion concerning certainchanges In the construction
of West Texas Avenue brought about by the failure of a subsoilstrata.
First,the repairof the failed area will be accomplished as follows:
Along the toe of the existing fill slope for a parallel distance of about
350feet and for a perpendicular distance of about 25 feet,the subsoil 1s
to be removed to a constant elevation of minus two feet (-21).The mucking
out operation will be worked simultaneously with a backfill operation so as
to maintain a balanced condition.The mucked outmaterial may be cast out
beyond the 25 foot distance from the slope toe.The backfill material shall
come from the damaged areaof the new embankment.We will mark on the ground
the exact extent of this operation.We will also takeoriginal cross sections1ntheareatobemuckedoutsotheamountofexcavationcanbeaccurately
determined.This operation,both excavation and backfilling will be paid for
at the rate for channel excavation given In the Contract and shall be based
on the cubic yards of excavated material.
After the mucked out zone 1s backfilled 1t shall be walked 1n and consoli
dated as much as possible,hopefully achieving a 90%Standard Proctor
Density.On top of this backfill a berm shall be constructed,again using
material from the new embankment.The area to be covered by this berm
shall be marked by us.The berm shall be brought up to elevation plusseven(+7)In eight Inch (8")lifts,each 11ft being compacted to a 95%
Standard Proctor Density.The slope at the outer edgeof the berm may be
constructed at a 2:1 slope to the water's edge.To determine the payment
for this work we will take crosssections before the mucking/backfilling
operation begins and calculate the amount of fill that was 1n place beforethefailureandpayforthatamountoffill.Then after the berm 1s con
structed a new set of cross sections will betaken as a base for subsequentfillwork.

When these cross sections are completed the hauling Is to be resumed to
bring the roadbed to the line and grade as given 1n the Plans.After this
1s accomplished,a set of final cross sections will be made which will
determine the amount of fill tobe paid for 1n this subsequent operation.
Two additional changes were discussed Involving the water and sewer line
Installation.The water line 1s simply tobe moved to the north side of
the bridge.The same lump sum bid applies for thesteel pipe span across
the bridge.The revised routing of the underground will be paid for at
the linear foot cost 1n the Contract.Any extra fittings will be paid for
at those quoted prices.It Is understood that PVC pipe of Class 150(SDR 17)1sto be substituted for the proposed A.C.pipe,but all prices
remain the same as quoted for A.C.pipe.
A similar substitution of PVC gravity sewer pipe 1s to be made for the
proposed V.C.pipe In the sanitary sewer line adjustments bid Item.The
work to be done under thisbid Hem 1s changed as reflected on the revised
drawings so that 1t Includes approximately 720 feetof 15"PVC gravity
sewer pipe.After providing credit for approximately 60 feet of V.C.pipe
your proposed add on to the lump sum bidfor Item 31 1s $18,000.00 chanainathatbidItemtoatotalof$42,000.00.
Finally,because the order of operations worked out so that the new bridge
piling 1s available sooner than anticipated,1t 1s possible to completebidItem31withoutconstructingthetemporarybypasscalledfor1nItem41.Your proposed credit for this bid Hem Is $27,500.00.which Is the
full amount less $500.00 1n shipping and handling chargescharged to youbythesupplier.*"J
