AN ORDINANCE OF THECITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS,AMENDING ORDINANCE NO.966 BYTHE AMENDMENT OF
THE "PERSONNEL POLICIES OF THE CITY OF BAYTOWN,"SECTION
3.04,VACATION,SO AS TO REPEAL THE PROVISIONS OF SUCH
SECTION AS PRESENTLY CONSTITUTED AND TO SUBSTITUTE IN
ITS PLACE A NEW SECTION 3.04;REPEALING ORDINANCES
INCONSISTENT HEREWITH;CONTAINING A SAVINGS CLAUSE;AND
PROVIDING FOR THE EFFECTIVE DATE HEREOF.
BE IT ORDAINED BYTHE CITY COUNCIL OF THECITY OF
BAYTOWN,TEXAS:
Section 1:That Ordinance No.966 is hereby amended by
the amendment of the "Personnel Policies of the City of
Baytown"by repealing Section 3.04,Vacation,thereof,and
the same shall cease to have force and effectfrom and after
the effective date of this ordinance.
Section 2:That the "Personnel Policies of the City of
Baytown"are hereby amended by adding thereto a new Section
3.04,Vacation,a copy of said section being attached hereto,
marked Exhibit "A,"and made a part hereof forall intents
and purposes.
Section 3:Repealing Clause:All ordinance or parts
of ordinances inconsistent with the terms of this ordinance
are hereby repealed;provided,however,that such repeal
shall be only to the extent of such inconsistency and in all
other respects this ordinance shall be cumulative of other
ordinances regulating and governing the subject matter
covered by this ordinance.
Section 4:Savings Clause:If any provision,section,
exception,subsection,paragraph,sentence,clause or phrase
of this ordinance or the application of same to any person
or set of circumstances,shall for any reason be held unconsitutional,
void or invalid,such invalidity shall not affect the validity
of the remaining provisions of this ordinance or their
application to other persons or sets of circumstances and to
this end all provisions of this ordinance are declared to be
severable.
Section 5:Effective Date:This ordinance shall take
effect from and after its passage by the City Council of the
City of Baytown.

be based upon the employee's date of hire,and the vacation schedule set
forth in (b)above.
(d)Upon completion of a six-month probationary period,an employee may take
five days of vacation.'Thereafter the employee shall take his accrued vaca
tion within the year following the anniversary date in which the vacation was
accrued.The City Manager may authorize exceptions to this policy onlywhen
it works a hardship on the City or the employee.
(e)Departmentheads shall schedule vacation time and reallocate duties to
cause minimum interruptions of the normal function and operation of their
department.Except for extreme cases,when provided by departmental budget,
or when approval of the City Manager is obtained,extra or "relief"employees
shall not be used to cover vacation leaves.
(f)Upon termination employees will be paid for earned vacation time up to
a maximum of thirty working days.
|PK (g)If an employee is on vacation and a holiday shouldoccur,the employee
—shall be granted an extra vacation day.
(h)All employees shall be required to take five days of vacation consecutively
at some time during the year.The remaining days of vacation may be taken in
periods desired by the employee provided vacation time is not taken in a period
of less than one-half day.
(i)This vacation policy shall go into effect on October 1,1975.After that
date as each permanent full-time employee reacheshis or her anniversary date
he or sheshall be granted vacation time in accordance withthe vacation schedule
set forth in ("b)above-However,all permanent,full-time non-Civil Service
employeeshiredprior to October 1,1975)shall continue to accrue a minimum
of fifteen days of annual vacation.All employees hired on or after October 1,
1975>shall accrue vacation time in accordance with the schedule set forth in
(b)above.
