ORDINANCE NO.1872
AN ORDINANCE OF THE CITY COUNCIL OFTHE CITY OFBAYTOWN,
TEXAS,ACCEPTING THE BID OF HANNA CONSTRUCTION COMPANY
FOR THE CONSTRUCTION OF ROLLINGBROOK DRIVE BRIDGES AND
AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THECITY
FOR THE SUM OF ONE HUNDRED FORTY-THREE THOUSAND FIVE
HUNDRED SIXTY AND NO/100 ($143,560.00)DOLLARS WITH
REGARDTO SUCH AGREEMENT.
WHEREAS,the City Council of the City of Baytown,
Texas,did authorize Busch,Hutchison &Associates,Inc.,
Consulting Engineers to the City of Baytown,to advertise
for bids for the construction of Rollingbrook Drive bridges
to be received August 21,1975;and
WHEREAS,notice to bidders as to the time and place,
when and where the contract for said construction would be
let was published pursuant to provisions of Vernon's Civil
Statutes,Article 2368a;and
WHEREAS,all bids were opened and publicly read at City
Hall at 10:00 o'clock a.m.,Thursday,August 21,1975,as per
published notice tobidders;NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN:
Section 1:That the City Council of the City of Baytown,
Texas,hereby accepts the bid of Hanna Construction Company,
according to the plans and specifications set forth by the
Consulting Engineers on a construction timetable of 100 working
days for the sum of One Hundred Forty-Three Thousand Five Hundred
Sixty and No/100 ($143,560.00)Dollars,and the Mayor and
City Clerk of the City are hereby authorized and directed to
execute and attest to a contract with Hanna Construction Company
for the construction of said bridges,containing the plans,
specifications,and requirements of the Consulting Engineers
and appropriate bond and drawn provisions in accordance with
the provisions of Vernon's Civil Statutes,Article 5160.
Section 2:That,pursuant to the provisions of Article
2368a,Section 2a,Vernon's Annotated Texas Statutes,the
City Manager is hereby granted general authority to approve
any change order involving a decrease or an increase in
costs of Five Thousand and No/100 ($5,000.00)Dollars or
less,subject to the proviso that the original contract
price may not be increased by more than twenty-five (25%)
percent or decreased by more than twenty-five (25%)percent
without the consent of the contractor to such decrease.
Section 3:This ordinance shall take effect from and
after its passage by the City Council of the City of Baytown.
