AN ORDINANCE OFTHECITY COUNCIL OF THE CITY OF
THE CITYOF BAYTOWN,TEXAS,AFFIRMING THAT AN
EMERGENCYSITUATION EXISTS AND AMENDING SECTION 2
OF ORDINANCE NO.1850,AUTHORIZING THE CONTRACTING
OF INDEBTEDNESS FOR THE REPLACEMENT OF THE PUMP ON
WATER WELL NO.5 AND PROVIDING FOR THE EFFECTIVE
DATE HEREOF.
WHEREAS,by the adoption of Ordinance No.1850 on
the 14th day of August,1975,the City Council of the City
-^of Baytown did authorize the emergency repair of WaterWell
r
No.5 and did further authorize the contracting of indebtedness
in an amount not to exceed Thirteen Thousand and No/100
($13,000.00)Dollars with Singer-Layne Texas Division for
such repair;and
WHEREAS,after pulling the well's pump to begin
the repair work,it was determined that the pump was in such
a condition that the pump would have to be replaced rather
than overhauled;and
WHEREAS,the cost for such replacement will exceed
the contract amount authorized by Ordinance No.1850 and it
f**is therefore necessary to revise said contract amount;and
WHEREAS,the emergencycondition which was found
to have existed at thetime of the adoption of Ordinance No.
1850 still exists because Water Well No.5 serves a large
area and a great number of people,and it is necessary to
return Water Well No.5 to an operating condition immediately
in order to preserve and protect the health,safety,and
welfare of the citizens of Baytown;and
WHEREAS,the City Council desires to amend Ordinance
No.1850 so asto authorize the contracting of indebtedness
for an amount sufficient to replace the pump on Water Well
No.5;NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN:
Section 1:That the City Council of the City of
Baytown,Texas,does herebyaffirm that an emergency situation
exists.
Section 2:That the City Council of the City of
Baytown,Texas,does hereby amend Section 2 of Ordinance No.
1850 to read as follows,to wit:
"Section 2.That the Mayor and City Clerk of the
City of Baytown are herebyauthorized and directed to enter
into a contract containing the usual performance and payment
bond provisions with Singer-Layne Texas Division for the
emergency installation (partsand equipment)of a new pump
for Water Well No.5 on a unit price basis;Thirteen Thousand
Fifty and 68/100 ($13,050.68)Dollars for materials,with
labor and equipment tobe paid for on a daily basis,that
being Four Hundred and No/100 ($400.00)Dollars per day,
with the total costs for materials and labor not to exceed
Sixteen Thousand and No/100 ($16,000.00)Dollars."
Section 3:This ordinance shall take effect from
and after its passage by the City Council of the City of
Baytown.
