Ordinance No. 1,859r ORDINANCE NO.1859 AN ORDINANCE OF THECITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,ACCEPTING THE BID OF VIRGINIA ERECTION CORPORATION FOR THE CLEANING AND PAINTING OFTHE 500,000 GALLON ELEVATED WATER TANK LOCATED ON BAYWAY DRIVE NEAR BAKER ROAD AND AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THE CITY FOR THESUM OF SIXTEEN THOUSAND THREE HUNDRED SIXTY-FIVE AND NO/100 ($16,365.00)DOLLARS WITH REGARD TO SUCH AGREEMENT. WHEREAS,the City Council of the City of Baytown, Texas,did authorize Jack A.Morton,City Engineer for the Cityof Baytown,to advertise for bids for the cleaning and painting of the 500,000 gallon elevated water tank located on Bayway Drive near Baker Road to be received August 18, 1975;and WHEREAS,notice to bidders as to thetime and place, when and where the contract for said cleaning and painting would be let was published pursuant to provisions of Vernon's Civil Statutes,Article 2368a;and WHEREAS,all bids were opened and publicly read at City Hall at 10:00 o'clock a.m.,as per published notice to bidders;NOW THEREFORE, BE IT ORDAINED BY THECITY COUNCIL OF THECITY OF BAYTOWN: Section 1:That the City Council of the City of Baytown, Texas,hereby accepts the bid of Virginia Erection Corporation, according to the plans and specifications set forth by the City Engineer on a construction timetable of 45 working days for thesum of Sixteen Thousand Three Hundred Sixty-Five and No/100 ($16,365.00)Dollars,and the Mayor and City Clerk of the City are hereby authorized and directed to execute and attest to a contract with Virginia Erection Corporation for the cleaning and paing of said water tank,containing the plans,specifications,and requirements of the City Engineer and appropriate bond and drawn provisions in accordance with the provisions of Vernon's Civil Statutes,Article 5160. Section 2:That,pursuant to the provisions of Article 2368a,Section 2a,Vernon's Annotated Texas Statutes,the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of Five Thousand and No/100 ($5,000.00)Dollars or less,subject to the proviso that the original contract price may not be increased by more than twenty-five (25%) percent or decreased by more than twenty-five (25%)percent without the consent of the contractor to such decrease. Section 3:This ordinance shall take effect from and after its passage by the City Council of the City of Baytown INTRODUCED,READ and PASSED by the affirmative vote of the City Council on this 28th day of August,1975.
