Ordinance No. 1,856`1 efflw, '" ORDINANCE NO. 1856 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AMENDING ORDINANCE NO. 899 TO EXCLUDE CERTAIN AREAS LOCATED WITHIN THE EXTRA- TERRITORIAL JURISDICTION OF THE CITY OF BAYTOWN FROM INDUSTRIAL DISTRICT NO. 3; REPEALING OR- DINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, the City Council of the City of Baytown adopted Resolution No. 514 setting forth an Industrial District Policy for the City of Baytown on July 10, 1975; and WHEREAS, in accordance with the Industrial District Policy set forth in Resolution No. 514, certain portions of Industrial District No. 3 have been annexed to the City of Baytown and are no longer within Industrial District No. 3 and as such, should be deleted from the provisions of Ordinance No. 899 adopted the 26th day of October, 1967, designating a part of the City of Baytown's extraterritorial jurisdiction as Baytown Industrial District No. 3; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the hereinafter described incorporated areas (described in Exhibit "A," attached hereto and made a part hereof for all intents and purposes) are hereby deleted from Industrial District No. 3. Section 2: Repealing Clause: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: Savings Clause: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 4: Effective Date: This ordinance shall take effect from and after its passage by the City Council of the City of Baytown.
