AN ORDINANCE OF THE CITY COUNCIL OFTHECITY OF BAYTOWN,
TEXAS,DECLARING THAT AN EMERGENCY SITUATION EXISTS;
AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERKTO
ENTER INTO A CONTRACTWITH LAYNE-SINGER COMPANY TO
INSPECTTHE PUMP,COLUMN,AND SHAFT OF WATER WELL NO.
5,LOCATED AT EAST JAMES AND SEVENTH STREET,IN ORDER
TO DETERMINE IF SAIDWELL CAN BE REHABILITATED AND AU
THORIZINGTHE CONTRACTING OF INDEBTEDNESS BY THE CITY
FOR SAID EMERGENCY REHABILITATION WITH THE COMPENSATION
THEREFOR NOT TO EXCEED THIRTEEN THOUSAND AND NO/100
($13,000.00)DOLLARS AND PROVIDING FOR THE EFFECTIVE
DATE HEREOF.
WHEREAS,Water Well No.5,located at East James and
Seventh Street,is in a present state of disrepair;and
WHEREAS,said water well serves a large area and a
great number of people;and
WHEREAS,it is necessary to preserve and protect the
health,welfare,and safety of the citizens of the City of
Baytown;and
WHEREAS,considering the above,the CityCouncil of the
City of Baytown deems that an emergency situation exists;
NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN,TEXAS:
Section 1:That the City Council of the City of Baytown,
Texas,hereby declares that an emergency situation exists.
Section 2:That the CityCouncil of the City of Baytown,
Texas,hereby authorizes and directs the Mayor and City
Clerk of the City of Baytown to enter into a contract with
Layne-Sanger Company to inspect the pump,column,and shaft
of Water Well No.5,located at East James and Seventh
Street,in order to determine if said well can be rehabilitated
and authorizes the contracting of indebtedness by the City
for said emergency rehabilitation with the compensation
therefor not to exceed Thirteen Thousand and No/100 ($13,000.00)
Dollars.

Section 3:That,pursuant to the provisions of Article
2368a,Section 2a,Vernon's Annotated Texas Statutes,the
City Manager is hereby grantedgeneral authority to approve
any change order involving a decrease or an increase in
costs of Five Thousand and No/100 ($5,000.00)Dollars or
less,subject to the proviso that the original contract
price may not be increased by more than twenty-five (25%)
per cent or decreased by more than twenty-five (25%)percent
without the consent of the contractor to such decrease.
Section 4:This ordinance shall take effect from and
r after its passage by theCity Council of theCity of Baytown.
