Ordinance No. 1,844ORDINANCE NO.1844 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,ACCEPTING THE BID OF KATY ENGINEERING COMPANY, CONTINGENT UPON APPROVAL OF THETEXAS WATER QUALITY BOARD ANDTHE ENVIRONMENTAL PROTECTION AGENCY,FOR THE ENLARGEMENT OF EAST DISTRICT SEWAGE TREATMENT PLANT, JOB NO.44B,CONTRACT NO.1,AND AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THE CITY FOR THE SUM OF ONE MILLION SIX HUNDRED THIRTY-THREE THOUSAND THREE HUNDRED THIRTY AND NO/100 ($1,633,330.00)DOLLARS WITH REGARD TO SUCH AGREEMENT. WHEREAS,the City Council of the City of Baytown, Texas,did authorize Langford Engineering,Inc.,Consulting Engineers to the City of Baytown,to advertise for bids for the enlargment of East District Sewage Treatment Plant,Job No.44B,Contract No.1,to be received August 6,1975;and WHEREAS,notice to bidders as to the time and place, when and where the contract for said construction would be let was published pursuant to provisions of Vernon's Civil Statutes,Article 2368a;and WHEREAS,all bids were opened and publicly read at City Hall at 5:00 o'clock p.m.,Wednesday,August 6,1975,as per published notice to bidders;NOW THEREFORE, BEIT ORDAINED BYTHECITY COUNCIL OF THECITY OF BAYTOWN: Section 1:That the City Council of the City of Baytown, Texas,hereby accepts the bid of Katy Engineering Company, contingent upon approval of the Texas Water Quality Board and the Environmental Protection Agency,according to the plans and specifications set forth by the Consulting Engineers for the sum of One Million Six Hundred Thirty-Three Thousand Three Hundred Thirty and No/100 ($1,633,330.00)Dollars,and the Mayor and City Clerk of the City are hereby authorized and directed to execute and attest to a contract with Katy Engineering Company for the enlargment of said sewage treatment /ta. plant,containing the plans,specifications,and requirements of the Consulting Engineers and appropriate bond and drawn provisions in accordance with the provisions of Vernon's Civil Statutes,Article 5160. Section 2:That,pursuant to the provisions of Article 2368a,Section 2a,Vernon's Annotated Texas Statutes,the City Manager is hereby grantedgeneral authority to approve any change order involving a decrease or an increase in costs of Five Thousand and No/100 ($5,000.00)Dollars or less,subject to the proviso that the original contract price may not be increased by more than twenty-five (25%) percent or decreased by more than twenty-five (25%)percent without the consent of the contractor to such decrease. Section 3:This ordinance shall takeeffect from and after its passage by the City Council of the City of Baytown.
