Ordinance No. 1,834ORDINANCE NO.1834 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS ACCEPTING THE BID OF BROWN &ROOT,INC.FOR THE CONSTRUCTION OF PHASE II,1975 STREET IMPROVEMENT PROGRAM AND AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THE CITY FOR THE SUM OF FOUR HUNDRED FIFTY-ONE THOUSAND FOUR HUNDRED SEVENTY-TWO AND 25/100 ($451,472.25)DOLLARS WITH REGARD TO SUCH AGREEMENT. WHEREAS,the City Council of the City of Baytown, Texas,did authorize the City Engineer of the City of Baytown, to advertise for bids for the construction of Phase II,1975 Street Improvement Program to be received July 22,1975;and WHEREAS,notice to bidders asto the time andplace, when and where the contract for said construction would be let was published pursuant to provisions of Vernon's Civil Statutes,Article 2368a;and WHEREAS,all bids were opened and publicly read at City Hall at 3:00 o'clock p.m.,Tuesday,July 22,1975,as per published notice to bidders;NOW THEREFORE, BE IT ORDAINED BY THECITY COUNCIL OF THE CITY OF BAYTOWN: Section 1:That the City Council of the City of Baytown, Texas,hereby accepts the bid of Brown &Root,Inc.,according to the plans and specifications set forth by the City Engineer on a construction timetable of 180 working days for thesum of Four Hundred Fifty-One Thousand Four Hundred Seventy-Two and 25/100 ($451,472.25)Dollars,and the Mayor and City Clerk of the City are herebyauthorized and directed to execute and attest to a contract with Brown &Root,Inc.for the construction of the following streets underPhase II,1975 Street Improvement Program:Craig,Deanne,Edison,Elm, West Gulf,High,West Humble,Olive,Pearl,South Pruett, Timberlane,Wildrose,and Decker Drive;containing the plans,specifications,and requirements of the City En gineer and appropriate bond and drawn provisions in accordance with the provisions of Vernon's Civil Statutes,Article 5160. Section 2:That,pursuant to the provisions of Article 2368a,Section 2a,Vernon's Annotated Texas Statutes,the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of Five Thousand and No/100 ($5,000.00)Dollars or less,subject to the proviso that the original contract price may not be increased by more than twenty-five (25%) percent or decreased by more than twenty-five (25%)percent without the consent of the contractor to such decrease.
