AN ORDINANCE FIXINGAND DETERMINING THE RATES AND
CHARGES FOR COMBINED LOCAL EXCHANGE TELEPHONE SERVICE
AND EXTENDED-AREA SERVICE AND FOR MISCELLANEOUS SERVICES
OF GENERAL TELEPHONE COMPANY OF THE SOUTHWEST IN THE
CITY OF BAYTOWN,TEXAS;REPEALING ORDINANCES INCONSISTENT
HEREWITH;CONTAINING A SAVINGS CLAUSE;PROVIDING FOR A
MAXIMUM PENALTY OF TWO HUNDRED ($200.00)DOLLARS;
ESTABLISHING AN EFFECTIVE DATE FOR THE RATES HEREIN
ESTABLISHED;AND PROVIDING FOR THE PUBLICATION HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THECITY OF BAYTOWN,
TEXAS:
Section 1:That the Code of Ordinances of the City of
Baytown,Texas,is hereby amended by the amendment of certain
sections of Chapter 13,"Utilities,"Article IV,"Telephone,"
by repealing the provisions of such sections as they are
presently constituted and substituting in their places new
sections as follows:
Section 31-35.Rates.
General Telephone Company of the Southwest
shall be authorized to charge within the corporate
limits of the City of Baytown,Texas,the following
schedules of principal rates for combined local
exchange service and extended-area service and for
such other charges and rates for miscellaneous
services not inconsistent with this ordinance as
are included in the TelephoneCompany's Texas
General Exchange Tariff and it shall be unlawful
for the Telephone Company to charge any higher
rate or rates for service of the types and classes
set forth:

Section 31-36.Service charges.
General Telephone Company of the Southwest
shall be authorized to charge within the corporate
limits of the City of Baytown,Texas,the following
schedule of service charges and such other charges
and rates for miscellaneous service charges not
inconsistentwith this ordinance as are included
in the Telephone Company's Texas General Exchange
.Tariff,and it shall be unlawful for the Telephone
Company to charge any higher rate or rates for
service charges of the types set forth:
EXHIBIT D
Section 31-39.Article establishes maximum rates.
The ratesandcharges provided in this article
shallbe the maximum charges for combined local
exchange service and extended-area service and for
miscellaneous services,applicable within the
corporate limits of the City.
Section 2:General Telephone Company of the Southwest
agrees that the City of Baytown shall have authority to
regulate the combined rates for local telephone service and
extended-area service in the City of Baytown in any future
ratecase for the City of Baytown,until the Public Utility
Commission of Texas assumes jurisdiction over rates and
services of General Telephone Company of the Southwest on
September 1,1976.Nothing contained in this ordinance
shall be construed now or hereafter as limiting or modifying,
in any manner,the right and power of the City of Baytown
under the law to regulate the combined rates for local
exchange services and extended-area service of General
Telephone Company of the Southwest for telephone service
within the City of Baytown,until the Public Utilities
Commission of Texas assumes jurisdiction over the rates and
services of General Telephone Company of the Southwest in
Baytown,Texas,norshall anything contained in this or
dinance limit the rights and remedies of General Telephone
Company of the Southwest under the law to secure changes in
the rates it is authorized to charge in order to provide
such company with a fair return on the fair value of its
property.
Section 3:That the terms of this ordinance shall,
upon written acceptance of such terms of the Telephone
Company,be and become a contract between the Cityand the
Telephone Company,and the rights,powers,limitations,
duties and restrictions herein provided shall inure to and
be binding upon the parties hereto and theirrespective
successors and assigns.

Section 4:Repealing Clause:All ordinances or parts
of ordinances inconsistent with the terms of this ordinance
are hereby repealed;provided,however,that such repeal
shall be only to the extent of such inconsistency and in all
other respects this ordinance shall be cumulative of other
ordinances regulating and governing the subject matter
covered by this ordinance.
Section 5:Savings Clause:If any provision,section,
exception,subsection,paragraph,sentence,clause or phrase
ofthis ordinance or the application of same to any person
or set of circumstances,shall for any reason be held un
constitutional,void or invalid,such invalidity shallnot
affect the validity of the remaining provisions of this
ordinance or their application to other persons or sets of
circumstances and to this end all provisions of this ordinance
are declared to be severable.
Section 6:Penalty Clause:Any person who shall
violated any provision of this ordinance shall be deemed
guilty of a misdemeanor and upon conviction shall be punished
by a fine of not less than Ten ($10.00)Dollars,nor more
than Two Hundred ($200.00)Dollars.Each day of the continuance
of such violation shall be considered a separate offense and
each andeveryday shall constitute a separate violation.
Section 7:Effective Date:This ordinance shall take
effect from and after ten (10)days from its passage by the
City Council.The City Clerk is hereby direct to give
notice hereof by causing the caption of this ordinance tobe
published in the official newspaper of the City of Baytown
at leasttwice within ten (10)days after the passage of
this ordinance.

GENERAL
Tie lines are furnished subject to the availability of circuits and provided
no unusualexpense is involved.If unusualexpenses are involved,the cir
cuits will bepriced as a special assembly ofequipment.
Tie lines nay terminate in switched system switchboards ofthe same customer
and on the same or different premises.For mileage charges applicable to tie
lines,see below.
Tie lines connecting switchboards of different customers are furnished with
the understanding that such tie lines are to be used only for communication
between stations directly connected to andlocatedon the same premises as
the switchboards involved.Such tie lines are provided only if eachof the
switchboards involved is connected to the central office by central office
trunks.
Tie lines connecting switchboards located on premises of the customer (except
where standard operation and transmission can be obtained on all connections)
are furnished for communication between stations directly connected to and
located on the same premises as the switchboards involved.Tie lines are used
in connection with central office trunks,off-premises stations,or other tielines.
Tie lines connectingswitchboards of the samecustomer contemplate connection
between any two stations connected to and on the same premises as the switch
boards in which the tie line terminates.In addition,such a tie line may be
connected (at either end,but not both ends simultaneously)to a central office
trunk for a through communication between astation connected to and located
on the same premises as the switchboard in which thetie line terminates and
any other station to which the central office trunk has access via local
exchange or the toll network.

The ratesand charges specified for nonswitched telephone service include
color and are in addition to the regular rates and charges for the main
service with which the nonswitched system is associated.
The basic ratesand charges specified for nonswitched telephone systems include
a batteryless power supply required for the operation of the various service
features.Where required,a battery reserve standby power arrangement naybe
providedat the rates and charges specified forpower plant service for small
switched systems (6 Amp,50 Ampere Hours'Reserve).
Nonswitched telephone service furnished off premises is subject to extension
line mileage charges as specified in the "Mileage Charges"section of this
tariff for each cable pair required.
Station audible signaling for nonswitchedtelephone systems may be provided by
individual bell,common bells,or common buzzers.Such signals,not to
exceed one individual bell per station.One common bell or common buzzer per
station will be furnished without additional charge.Station signals will be
limited to the number which will operate satisfactorily on a line.
Where,in the opinion of the Telephone Company,messages cannot be satisfac
torily transmitted from or to any onestation by using standard equipment
and itis feasible to overcome thetransmission difficulties by using special
equipment,facilities,or arrangements,or when a customer desires features
other than those regularly available,the service will be provided ataddi
tional rates or charges based on the circumstances in each individual case.

ORDINANCE NO. 1819
ACCEPTANCE
WHEREAS, the City Council of the City of Baytown,
Texas , did on the 26th day of June, 1975, enact an ordinance
entitled:
"AN ORDINANCE FIXING AND DETERMINING THE RATES AND
CHARGES FOR COMBINED LOCAL EXCHANGE TELEPHONE
SERVICE AND EXTENDED-AREA SERVICE AND FOR MIS-
CELLANEOUS SERVICES OF GENERAL TELEPHONE COMPANY
OF THE SOUTHWEST IN THE CITY OF BAYTOWN, TEXAS;
REPEALING ORDINANCES INCONSISTENT HEREWITH;
CONTAINING A SAVINGS CLAUSE; PROVIDING FOR A
MAXIMUM PENALTY OF TWO HUNDRED ($200. 00) DOLLARS;
ESTABLISHING AN EFFECTIVE DATE FOR THE RATES
HEREIN ESTABLISHED; AND PROVIDING FOR THE PUB-
LICATION HEREOF. "
and
WHEREAS, said Ordinance was on the 26th day of
June, 1975 , duly approved by the Mayor of said City and the
seal of said City was thereto affixed and attested by the
City Clerk:
NOW THEREFORE, in compliance with the terms of
said Ordinance as enacted, approved and attested, the General
Telephone Company of the Southwest hereby accepts said
Ordinance and files this its written acceptance with the
City Clerk of the City of Baytown, Texas, in her office.
