Ordinance No. 1,816ORDINANCE NO.1816 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,DECLARING THATAN EMERGENCY SITUATION EXISTS; AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO ENTER INTO A CONTRACT WITH REHAB SPECIALISTS,INC.FOR LABOR AND EQUIPMENT NECESSARY TO CLEAN APPROXIMATELY 3900 FEET OF EIGHTEEN (18")INCH SANITARY SEWER MAIN ALONG BROWNWOOD DRIVE ON A UNIT PRICE BASIS OF THIRTY- TWOAND 50/100 ($32.50)DOLLARS PER HOUR,WITH COM PENSATION TO REHAB SPECIALISTS,INC.NOT TO EXCEED TEN THOUSAND AND NO/100 ($10,000)DOLLARS AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS,approximately 3900 feet of eighteen (18")inch sanitary sewer line along Brownwood Drive is partially blocked by sand and other debris causing sewage overflow during peak loading periods;and WHEREAS,said sanitary sewer line serves a large area and a great number of people;and WHEREAS,it is necessary to preserve and protect the health,welfare,and safety of the citizens of the City of Baytown;and WHEREAS,considering the above,the City Council of the City of Baytown,deemsthat an emergency situation exists; r?P*s NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1:That the City Council of the City of Baytown, Texas,hereby declares that an emergencysituation exists. Section 2:That the Mayor and City Clerk of the City of Baytown are hereby authorized and directed to enter into a contract with Rehab Specialists,Inc.for labor and eqipment necssary to clean approximately 3900 feet of eighteen (18") inch sanitary sewer main along Brownwood Drive as follows, to wit: One Bucket-line machine Two Men One Pickup on a unit pricebasis of Thirty-Two and 50/100 ($32.50) Dollars per hour,withcompensation to Rehab Specialists, Inc.not to exceed Ten Thousand and No/100 ($10,000)Dollars. Section 3:That,pursuant to the provisions of Article 2368a,Section 2a,Vernon's Annotated Texas Statutes,the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of Five Thousand and No/100 ($5,000.00)Dollars or less,subject to the proviso that the originalcontract price may not be increased by morethan twenty-five (25%) per cent without the consent of the contractor to such decrease. Section 4:This ordinance shall take effect from and after its passage by the City Council of the City of Baytown.
