AN ORDINANCE OF THE CITY COUNCIL OF THECITY OF BAYTOWN,
TEXAS,AMENDING THE "HANDBOOK OF CIVIL SERVICE RULES
FOR FIREMEN'S AND POLICEMEN'S CIVIL SERVICE SYSTEM"BY
THE REPEAL OF THAT PORTION OF RULE VII,SECTION 42,
ENTITLED,"EYES,"SO ASTO REPEAL THE PROVISIONS OF
SUCH SUBSECTION AS PRESENTLY CONSTITUTED AND TO SUB
STITUTE IN ITS PLACE NEW PROVISIONS;REPEALING ORDINANCES
INCONSISTENT HEREWITH;CONTAINING A SAVINGS CLAUSE;AND
PROVIDING FOR THE EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN,TEXAS:
Section 1:That the "Handbook of Civil Service Rules
for Firemen's and Policemen's Civil Service System"is
hereby amended by repealing that portion of Rule VII,Section
42,entitled "Eyes,"and the same shall cease to have force
and effect from and after the effective date of this ordinance.
Section 2:That the "Handbook of Civil Service Rules
of Firemen's and Policemen's Civil Service System"is hereby
amended by adding thereto a new Subsection to that portion
of Rule VII,Section 42,entitled "Eyes,"which shallread
as follows,to wit:
RULE VII.APPLICANTS
Section 42.
Eyes.Good vision isa prime requirement.Unaided
vision of 20/100 binocularmay be accepted if a corrected
vision of 20/20 in one eye with not less than 20/30 in the
othercan be achieved.Applicants will be required to
secure and wear corrections for any deviations before any
appointment.Applicants must be able to show satisfactory
evidence that they can distinguish primary colors.Complete
color blindness is cause for rejection.There must be no
crossing or other physical abnormality of the eyes.
Section 3:Pursuant to Section 8-15 of the Code of
Ordinances of the City of Baytown,the Commission shall
cause this amendment tobe printed and made available upon
demand.
Section 4:Repealing Clause:All ordinances or parts
of ordinances inconsistent with the terms of this ordinance
are hereby repealed;provided,however,that such repeal
shall be only to the extent of such inconsistency and in all
other respects this ordinance shall be cumulative of other
ordinances regulating and governing the subject matter
covered by this ordinance.
Section 4:Savings Clause:If any provision,section,
exception,subsection,paragraph,sentence,clause or phrase
of this ordinance or the application of same to any person
or set of circumstances,shall for any reason be held un
constitutional,void or invalid,such invalidity shall not
affect the validity of the remaining provisions of this
ordinance or their application to other persons or sets of
circumstances andto this end all provisions of this ordinance
are declared tobe severable.
Section 7:Effective Date:This ordinance shall take
effect from and after its passage by the City Council of the
City of Baytown.
