AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS,DECLARING THAT A VACANCY EXISTS ONTHE BOARD OF
EQUALIZATION OF THE CITY OF BAYTOWN,TEXAS,AND AP
POINTING A MEMBER TO FILL SAID VACANCY AND PROVIDING
FOR THE EFFECTIVE DATE HEREOF.
WHEREAS,on the 22nd day of May,1975,the City Council
of the City of Baytown,pursuant to Article 7,Section 83 of
the Charter of the City of Baytown,did appoint C.Frank
Terry,Charles L.Umholtz,and Eileen Caffey,three residents
of the City of Baytown who are qualified voters and owners
of real property in the City of Baytown,as the Board of
Equalization of the City of Baytown;and
WHEREAS,because ofillness,Charles L.Umholtz is
unable to serve on the Board of Equalization;and
WHEREAS,because it is necessary forthe Board of
Equalization to continuously engage in the performance of
its official functions and because of the nature and importance
of such official functions,it is not only desirable but
essential that the Board of Equalization operate at full
strength with three members;NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN,TEXAS:
Section 1:That the City Council of the City of Baytown
does hereby declare that because of the illness of Charles
L.Umholtz,there exists on the Board of Equalization of the
City of Baytown,Texas,a vacancy.
Section 2:That Truitt C.Smith,a resident citizen of
the City of Baytown,a qualified voter and a real property
owner,is hereby appointed and shall serve on the Board of
Equalization in the position vacated by Charles L.Umholtz.
The said Truitt C.Smith shall serve as a member of the
Board of Equalization from and after the effective date of
this ordinance and as long thereafter as may be necessary
forthe Board to hear,review,and determine the value and
assessment of all property,both real andpersonal,within
the City of Baytown as said appear on the Tax Roll forthe
year 1975.
Section 3:It shall be the duty of said Truitt C.
Smith,together with the other members of the Board of
Equalization tohear and determine the complaint of any
person that assessments of property,as made and returned by
the City Tax-Assessor Collector,are in excess of the true
value of said property and to review,examine,and if necessary,
revise the assessment as returned by the City Tax-Assessor
Collector,to theend that all property within the City
shall be assessed as fairly and as uniformly as possible.
The said Truitt C.Smith,together with the other members of
the Board of Equalization shall have the authority and shall
exercise all the powers and fulfill allthe duties granted
and conferred upon it by the express provisions of the
Charter of the City of Baytown.
Section 4:This ordinance shall take effect immediately
from and after its passage by the City Council of the City
of Baytown,Texas.
