Ordinance No. 1,810ORDINANCE NO.1810 AN ORDINANCE OF THECITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,ACCEPTING THE BID OF SHUR-FLO,INC.FOR THE SLIP- LINING OF AN EIGHTEEN (18")INCH SANITARY SEWER LINE ON JAMES BOWIE DRIVE AND AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THE CITY FOR THE SUM OF FORTY-FIVE THOUSAND THREE HUNDRED THREE AND 78/100 ($45,303.78)DOLLARS WITH REGARDTO SUCH AGREEMENT. WHEREAS,the City Council of the City of Baytown, Texas,did authorize the Engineering Department for the City of Baytown,to advertise for bids for the sliplining of an eighteen (18")inch sanitary sewer line on James BowieDrive to be received June 9,1975;and WHEREAS,notice to bidders as to the time and place, when and where the contract for said construction would be let was published pursuant to provisions of Vernon's Civil Statutes,Article 2368a;and WHEREAS,all bids wereopened and publicly read at City Hall at 10:00 o'clock a.m.,Monday,June 9,1975,as per published notice to bidders;NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1:That the City Council of the City of Baytown, Texas,hereby accepts the bid of Shur-Flo,Inc.,according tothe plans and specifications set forth by the Engineering Department of the City of Baytown,on a construction timetable of thirty (30)days forthesum of Forty-Five Thousand Three Hundred Threeand 78/100 ($45,303.78)Dollars,andthe Mayor and City Clerk of the City are hereby authorized and directed to execute and attest to a contract with Shur-Flo,Inc.forthe sliplining of said sanitary sewer line containing theplans, specifications,and requirements of the Engineers and appropriate bond and drawn provisions in accordance with the provisions of Vernon's Civil Statutes,Article 5160. g Section 2:That,pursuant to the provisions of Article 2368a,Section 2a,Vernon's Annotated Texas Statutes,the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of Five Thousand and No/100 ($5,000.00)Dollars or less,subject to the proviso that the original contract price may not be increased by more than twenty-five (25%) percent or decreased by more than twenty-five (25%)percent without the consent of the contractor to such decrease. Section 3:This ordinance shall takeeffect from and after its passageby the City Council of the City of Baytown.
