AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS,ACCEPTING THE BID OF SINGER-LAYNE TEXAS FOR THE
INSTALLATION OF NEW PUMPS FOR WATER WELLS 9 AND 14 AND
AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THE CITY
FOR THE SUM OF THIRTY-SIX THOUSAND TWO HUNDRED THIRTY-
FOUR AND NO/100 ($36,234.00)DOLLARS WITH REGARD TO
SUCH AGREEMENT.
WHEREAS,the City Council of the City of Baytown,
Texas,did authorize Busch,Hutchison &Associates,Inc.,
Consulting Engineers to the City of Baytown,to advertise
for bids for the installation (parts and labor)of new pumps
for WaterWells 9 and 14 tobe received May 15,1975;and
WHEREAS,notice to bidders as to the time and place,
when and where the contract for said installation would be
let was published pursuant to provisions of Vernon's Civil
Statutes,Article 2368a;and
WHEREAS,all bids were opened and publicly read at City
Hall at10:00 o'clock a.m.,Thursday,May 15,1975,as per
published notice to bidders;NOW THEREFORE,
BE IT ORDAINED BYTHE CITY COUNCIL OF THE CITY OF
BAYTOWN:
Section 1:That the City Council of the City of Baytown,
Texas,hereby accepts the bid of Singer-Layne Texas,according
to the plansand specifications set forth by the Consulting
Engineers on a construction timetable of 60 days forthe sum
of Thirty-Six Thousand Two Hundred Thirty-Four andNo/100
($36,234.00)Dollars and the Mayor and City Clerk of the
City are hereby authorized and directed to execute and
attest to a contract with Singer-Layne Texas for the in
stallation (parts and labor)of new pumps for Water Wells 9
and 14,containing the plans,specifications,and requirements
of the Consulting Engineers and appropriate bond and drawn
provisions in accordance with the provisions of Vernon's
Civil Statutes,Article 5160.

Section 2:That,pursuant to the provisions of Article
2368a,Section 2a,Vernon's Annotated Texas Statutes,the
City Manager is hereby granted general authority to approve
any change order involving a decrease or an increase in
costs of Five Thousand and No/100 ($5,000.00)Dollars or
less,subject to the proviso that the original contract
price may not be increased by more than twenty-five (25%)
percent or decreased bymore than twenty-five (25%)percent
without the consent of the contractor to such decrease.
Section 3:This ordinance shalltake effect from and
r after its passage by the City Council of the City of Baytown,
INTRODUCED,READ and PASSED by the affirmative vote of
the City Council on this 22nd day of May,1975.
