Ordinance No. 1,793ORDINANCE NO.1793 AN ORDINANCE OF THE CITY COUNCIL OFTHE CITY OF BAYTOWN, TEXAS,AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK OF THE CITY OF BAYTOWN TO EXECUTE ANDATTEST TOA CONTRACT WITH THE HOUSTON-GALVESTON AREA COUNCIL FOR THE PURCHASE OF LAW ENFORCEMENT TECHNICALEQUIPMENT AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1:That the City Council of the City of Baytown, Texas,hereby directs the Mayor and City Clerk of the City of Baytown to execute and attest to a contract between the City of Baytown and the Houston-Galveston Area Council for the purchase of law enforcement technical equipment.A copy of said contract is attached hereto,marked Exhibit "A,"and made a part hereof forall intents and purposes. Section 2:This ordinance shall take effect from and after its passage bythe City Council ofthe City of Baytown. INTRODUCED,READ and PASSED by the affirmative vote of the City Council of the City of Baytown this 3th day ofMay, 1975. ■CTTg*?-— TOM GENTRY,Mayor ATTEST: EDNA OLIVER,City Clerk APPROVED: NEEL RICHARDSON,City Attorney ■?■• EXHIBIT "A1 / THE STATE OF TEXAS () 0 THE CITY OF () This agreement made the day of 19 between the City of ,Texas and the Houston-Galveston Area Council,a Council of Government of the State of Texas: WITNESSETH Pursuant to the authority granted by the Texas Interlocal Cooperation Act (Article 4413(32c)VTCS)providing for cooperation between local governmental bodies,the parties hereto,in consideration of the premises and the mutual promises contained herein,agree as follows: The City of hereinafter referred toas "City"hereby makes,constitutes and appoints the Houston-Galveston Area Council,- hereinafter referred to as "Council,"its true and lawful purchasing ^agent for the purchase of certain items of Law Enforcement Technical Equipment as part of a Regional Law Enforcement Technical Equipment purchase.The City agrees that the Council shall be the exclusive purchasing agent for said equipment. II. The City agrees that all specifications for such equipment shall /p*\'be determined and prepared by the Council. III. .The Council shall,at the request of the City,not later than thirty days following receipt ofthe bids,submit to the City a complete tabulation ofall bids received and shall certify asto the lowest and best bidder.Allpurchases from competitive bidders shall be from thelowest and best bidder.In the event the lowest bidder is not considered by the Council to be.the best bidder and accordingly the Council certifies some other bidder as the lowestand best bidder it shall include an explanation and report its findings when it r*transmits caid tabulation to the City.The lowest and best bid shall be determined solely by the council. IV. .This agreement shall take effect upon execution by the signatories. V. This agreement shall continue in effect from the date of execution until completion of the installation/delivery.
