AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE
CITY OF BAYTOWN,TEXAS,BY THE AMENDMENT OF CHAPTER 18,
"MOTOR VEHICLES AND TRAFFIC,"BY AMENDING SECTION 18-122.1
THEREOF,SO AS TO REPEAL THE PROVISIONS OF SUCH SECTION
AS PRESENTLY CONSTITUTED AND TO SUBTITUTE IN ITS PLACE
THE PROVISIONS OF ANEW SECTIONSETTING OUT TIME LIMIT
PARKING ZONES AS CONTEMPLATED BY SECTION 18-122 OF THE
CODE OF ORDINANCES;PRESCRIBING A PENALTY;PROVIDING A
REPEALING CLAUSE;CONTAINING A SAVINGS CLAUSE;AND
PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF.
BEIT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN,TEXAS:
Section 1:That the Code of Ordinances of the City of
Baytown,Texas,is hereby amended by amending Chapter 18,
"Motor Vehicles and Traffic,"by repealing Section 18-122.1
thereof,and the sameshall cease to have forceand effect
from and afterthe effective date of this ordinance.
Section 2:That the Code of Ordinances herein,is
hereby amended by adding thereto a new Section 18-122.1,in
Chapter 18,"Motor Vehicles and Traffic,"which shall read
as follows,to wit:
Section 18-122.1 Designation of time limit parking zones.
(a)The following named and described areas,
streets,or portions of streets,or such other areas,
streets,or portions of streets as may hereafter be
included in this section by amendment thereto,laying
within the corporate limits ofthe City of Baytown,
Texas,shall constitute two (2)hour time limit parking
zones,as contemplated by Section 18-122 of this Chapter.
ASHBELSTREET from Pearce Avenue to Defee Avenue;
COMMERCE STREET from Pearce Avenue to Defee Avenue;
DEFEE Avenue from Pruett Street to Commerce Street,
except for the first three (3)parking places on the
north side of Defee Avenue east of the intersection
of Defee Aveneu with Gaillard Street;
GAILLARD STREET from Pearce Avenue to Defee Avenue;
except for thefirstseven (7)parking places on
the east side of Gaillard Street from its intersection
with Defee Avenue;
JONES STREET from Pearce Avenue to Defee Avenue;
MAIN STREET from Pearce Avenue to Defee Avenue;
MARKET STREET on the south side of Market Street
between Wisconsin and the intersection of Finley
Street with Market Street;
PEARCE Avenue from Whiting Street to Commerce Street;
TEXAS AVENUE from Whiting Street to First Street.
(b)The following named and described areas,
streets,or portions of streets,orsuch other areas,
streets,or portions of streets as may hereinafter be
included in this section by amendment thereto,laying
within the corporate limits of the City of Baytown,
Texas,shall constitute fifteen (15)minute timelimit
parking zones,as contemplated by Section 18-122 of
this Chapter.
DEFEE AVENUE from the first three parking places on
the north side of Defee Avenue east of the inter
section of Defee Avenue with Gaillard Street;
GAILLARD STREET the firstseven parking places on
the east side of Gaillard Street from the inter
section of Gaillard Street with Defee Avenue.
(c)The time limits pertaining to the above
described time-limit parking zones shall apply every
day between the hours of eight (8)o'clock a.m.andsix
(6)o'clock p.m.,except Sundays and legal holidays
observed by the City.
(d)It shall be unlawful and a violation of the
provisions of this section for any person:
(1)Topermit any vehicle registered in the
name of or operated by such person tobe parked
beyond the period of legal parking established in
any of the designated time limit parking zones.
(2)Topark vehicle across any lineor
marking of a time limit parking zone soas to not
be entirely within the area designated bysuch
lines or markings.
(3)To deface or remove or otherwise tamper
with anysign or marking designating an area as a
time parking zone.
(e)Any person,firm or corporation who shall
violate any of the provisions of this section pertaining
to the overtime parking shall be deemed guilty of an
offense and shall be punished by a fineof Four Dollars
($4.00).If the fine is paid in the Municipal Court on
or before ten (10)days from the date of the ticket,a
Two Dollar ($2.00)discount shall be allowed.If the
fine is not paid after the expiration of ten (10)days
from the date of the ticket,a capias may be issued,
andthe violator may be required to post a bond of up
to Two HundredDollars ($200.00).

Section 3:Repealing Clause:All ordinances or parts
of ordinances inconsistentwith the terms of this ordinance
are hereby repealed;provided however,that such repeal
shall be only to the extent of such inconsistency and in all
other respects this ordinance shall be cumulative of other
ordinances regulating and governing the subject matter
covered by this ordinance.
Section 4:Savings Clause:If any provision,exception,
section,subsection,paragraph,sentence,clause or phrase
of this ordinance or the application ofsame to any person
or set of circumstances shall for any reason be held unconstitutional,
void or invalid,such invalidity shall not affect the validity
of the remaining provisions of this ordinance or their
application to other persons or sets of circumstances and to
this end,all provisions of this ordinance are declared to
be severable.
Section 5:Effective Date:This ordinance shall take
effect from and after ten (10)days from its adoption by the
City Council of the City of Baytown,Texas.The City Clerk
is hereby directed to give notice hereof by causing the
caption of this ordinance to be published in the official
newspaper of the City of Baytown at leasttwice within ten
(10)days after passage.
