Ordinance No. 1,752ORDINANCE NO.1752 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,AMENDING CHAPTER 31,"UTILITIES,"ARTICLE IV, WATER SERVICE,SECTION 31-55,WATER TAPPING FEES,AND ARTICLE V,SEWER SERVICE,SECTION 31-67,SEWER TAPPING FEES,TO REPEAL THE PROVISIONS OF SUCH SECTIONS AS PRE SENTLY CONSTITUTED AND TO SUBMIT IN THEIR PLACES NEW SECTIONS 31-55 AND 31-67;REPEALING ORDINANCES INCON SISTENT HEREWITH;CONTAINING A SAVINGS CLAUSE;AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1:That the Code of Ordinances of the City of Baytown is hereby amended by the amendment of Chapter 31, "Utilities,"Article IV,Water Service,by repealing Section 31-55,Water tapping fees,thereof and the same shallcease to have force and effect from and after the effective date of this ordinance. Section 2:That the Code of Ordinances is hereby amended by adding thereto a new Section 31-55,Water tapping fees,which shall read as follows,to wit: Section 31-55.Water tapping fees. The following fees shall be assessed and collected by the water billing department (Utility Office Manager) for water taps: (1)3/4 inch water tap $100.00 (2)1 inch water tap $160.00 All other taps (1.5"and larger)and other special water connections will be determined by the utility office manager after consultation with the Director of Public Works or his designee. Section 3:That the Code of Ordinances of the City of Baytown is hereby amended by the amendment of Chapter 31, "Utilities,"Article V,Sewer Service,by repealing Section 31-67,Sewer tapping fees,thereof and the same shall cease to have force and effect fromand after the effective date of this ordinance. Section 4:That the Code of Ordinances is hereby amended by adding thereto a new Section 31-67,Sewer tapping fees,which shall read as follows,to wit: Section 31-67.Sewer tapping fees. The following fees shall be assessed and collected by the water billing department (Utility Office Manager) for sewer taps: (1)4 inchsewer tap $70.00 (2)6 inchsewer tap $100.00 All other taps (8"and larger)and other special connections will be determined by the utility office manager after consultation with the Director of Public Works or his designee. Section 5:Repealing Clause:All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed;provided,however,that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 6:Savings Clause:If any provision,section, exception,subsection,paragraph,sentence,clause,or phrase of this ordinance or the application of same to any person or set of circumstances,shall for any reason be held unconstitutional,void orinvalid,such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or set of circumstances and to this end all provisions of this ordinance are declared to be severable. -2- Section 7:Effective Date:The provisions of this ordinance shall become effective onthe1st day of April, 1975.
