AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF BAYTOWN,TEXAS,AMENDING CHAPTER 31,
"UTILITIES,"ARTICLE II,NATURAL GAS SERVICE,
SECTION 31-20,POSTING RATES AT COMPANY
OFFICE,TO REPEAL THE PROVISIONS OF SUCH
SECTION AS PRESENTLY CONSTITUTED AND TO
SUBMIT IN ITS PLACE A NEW SECTION 31-20;
REPEALING ORDINANCES INCONSISTENT HREWITH;
CONTAINING A SAVINGS CLAUSE;AND PROVIDING
FOR THE EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN,TEXAS:
Section 1:That the Code of Ordinances of the City of
Baytown is hereby amended by the amendment of Chapter 31,"Utilities,"
Article II,Natural Gas Service,by repealing Section 31-20,
Posting rates at company office,thereof and the same shall cease
to have forceand effect from and after the effective date of
this ordinance.
Section 2:That the Code of Ordinances is hereby
amended by adding thereto a new Section 31-20,Posting rates at
company office,which shall read as follows,to wit:
Section 31-20.Posting rates at company office.
The Company shall establish and post in its
office rate schedules providing monthly billing rates
complying with Section 31-18 and 31-19 of the Code of
Ordinances.The rates specified in Section 31-18 and
31-19 shall be applicable to all consumers using 150,000
cubic feet or less of gas per month.Notwithstanidng
any other provision of this Article,the rates for
consumers using more than 150,000 cubic feet or more in
any month (hereinafter called "large volume consumers")
shallbe the rates for large volume consumers established
by the Company.Such rates shall be open to inspection
bythe City.It is understood that the City Council
does not hereby waive or relinquish any legal right or
authority which the City has or may have to fixand
regulate gasrates in the future;and all revenues
received by the Company from its large volume consumers
served from the Company's distribution system shall be
^taken into account in consideration by the City Council
v of any alterations in domestic ratesfixed by an or
dinance of the City.
Section 3:Repealing Clause:All ordinances or parts
of ordinances inconsistent with the terms of this ordinance are
hereby repealed;provided,however,that such repeal shall be
only to the extent of such inconsistency and in all other re
spects this ordinance shall be cumulative of other ordinances
regulating and governing the subject matter covered by this
ordinance.
Section 4:Savings Clause:If any provision,section,
exception,subsection,paragraph,sentence,clause or phrase of
this ordinance or the application of same to any person or set of
circumstances,shall for any reason be held unconstitutional,
void or invalid,such invalidity shallnot affect the validity of
the remaining provisions of this ordinance ortheir application
to other persons or set of circumstances and to this end all
provisions of this ordinance are declared to be severable.
Section 5:Effective Date:This ordinance shall take
effect immediately from and after its passage by the City Council
of the City of Baytown,Texas.
