ORDINANCE NO.1740
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS,DECLARING THAT AN EMERGENCY SITUATION EXISTS;
AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND
ATTEST TO ACONTRACT WITH NAYOR PIPE CLEANING COMPANY
FOR THE EMERGENCY REPAIR OF SANITARY SEWER LINES ON AN
ESTIMATED FOOTAGE BASISAND AUTHORIZING THE CONTRACTING
OF INDEBTEDNESS BY THE CITY FOR SAID EMERGENCY REPAIR
WITH THE COMPENSATION TO BE PAID TO BE BASED UPON THE
AMOUNT OF SLIPLINING REQUIRED AND PROVIDING FOR THE
EFFECTIVE DATE HEREOF.
WHEREAS,there exists at certain locations in the City
of Baytown sanitary sewer lines in a present state of disrepair
due to pipe deterioration and resulting cave-ins;and
WHEREAS,said sewer lines service largeareas and a
great number of people;and
WHEREAS,it is necessary to perserve and protect the
public health of the citizens of the City of Baytown;and
WHEREAS,considering the above,the City Council of the
City of Baytown,deems that an emergency situation exists;
NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
_BAYTOWN,TEXAS:
Section 1:That the City Council of the City of Baytown,
Texas,hereby declares that an emergency situation exists.
Section 2:That the Mayor and City Clerk of the City
of Baytown are hereby authorized and directed to enter into
a contract containing the usual performance and payment bond
provisions with Naylor Pipe Cleaning Company forthe emergency
repair of sanitary sewer lines at the following locations on
an estimated footage basis as follows:
1.Woodlawn,fromEast Fayle to Dwinnell -$3.92 per
foot.
Estimated amount of sliplining is 2,000 L.F.
2.In the alley betweenClayton and Raintree,from
Ivie Lee to Ward Road -$2.80 per foot.
Estimated amount of sliplining is 1,300 L.F.
3.Memorial Drive,fromDecker to 500 feeteast -
$3.88 per foot.
Estimated amount of sliplining is 500 L.F.
with compensation to be paid tobe based upon the actual
amount of sliplining required.
Section 3:That,pursuant to the provisions of Article
23 6 8a,Section 2a,Vernon's Annotated Texas Statutes,the
City Manager is hereby granted general authority to approve
any change order involving a decrease or an increase in
costs of Five Thousand and No/100 ($5,000.00)Dollars or
less,subject to the proviso that the originalcontract
price maynot be increased by more than twenty-five (25%)
per cent or decreased by more than twenty-five (25%)per
cent without the consent of the contractor to such decrease.
Section 4:This ordinance shall take effect from and
after its passage bythe City Council of the City of Baytown.
