AN ORDINANCE AMENDING THE CODE OF ORDINANCES
OF THE CITY OF BAYTOWN,TEXAS,BY THE AMENDMENT
OF CHAPTER 1,"ADMINISTRATION,"BY AMENDING
ARTICLE V,"INSURANCE ADVISORY COMMITTEE,"
SUBSECTIONS 2-110(a)AND 2-111 THEREOF,SO AS
TO REPEAL THE PROVISIONS OF SUCH SUBSECTIONS
AS PRESENTLY CONSTITUTED,AND TO SUBSTITUTE
IN THEIR PLACE NEW PROVISIONS,AND BY DELETING
SUBSECTION 2-110(e)SO AS TO REPEAL THE
PROVISIONS OF SUCH SUBSECTION AND THE SAME
SHALL CEASE TO HAVE FORCE AND EFFECT;REPEALING
ORDINANCES INCONSISTENT HEREWITH;CONTAINING
A SAVINGS CLAUSE;AND PROVIDING FOR THE EF
FECTIVE DATE HEREOF.
BE IT ORDAINED BYTHECITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1:That the Code of Ordinances of the City of
Baytown,Texas,is hereby amended by amending Chapter 2,"Admin
istration,"by amending Article V,"Insurance Advisory Committee,"
by repealing Subsecton 2-110(a)thereof,and the same shall cease
to have forceand effect from and after the effective date of
this ordinance.
Section 2:That the Code of Ordinances of the City of
Baytown is hereby amended by adding thereto a new Subsection 2-
110(a)in Chapter 2,Article V,which shall read as follows,to
wit:
Sec.2-110.Policy assignment procedure.
(a)Each year,at a time designated by theexe
cutive committee chairman and sufficiently early to
assure continuity of complete insurance protection for
the city,the city's fire insurance policy shall be
written for a period deemed by the executive committee
to be most advantageous to the city considering the
current insurance market,at rates developed by the
Fire and Allied Lines Subcommittee,subject to the
specifications of the City of Baytown as determined by
its Council or designated officers and in conformance
with the Insurance Code of Texas.
The Advisory Committee shall determine the as
signment ofthis policy and immediately advise the City
Manager of the assignment and the term of the policy.
Section 3:That the Code of Ordinances of the City of
Baytown,Texas,is hereby amended by amending Chapter 2,"Ad
ministration,"by amending Article V,"Insurance Advisory Com
mittee,"by deleting Subsection 2-110(e)soas to repeal the
provisions of such subsection and the same shallcease to have
force and effect from and after the effective date ofthisor
dinance.
Section 4:That the Code of Ordinances of the City of
Baytown,Texas,is hereby amended by amending Chapter 2,"Ad
ministration,"by amending Article V,"Insurance Advisory Com
mittee,"by repealing Subsection 2-111 thereof,andthe same
shall cease to have force and effect from and after the effective
date of this ordinance.
Section 5:That the Code of Ordinances is hereby amended by
adding thereto a new Subsection 2-111 in Chapter 2,Article V,
which shall read as follows,to wit:
Sec.2-111.Commissions.
All earned commissions on all policies,excluding
contingent commissions,shall be distributed equally
among all the advisory committee members at suchtime
and in such manner as the advisory committee maydetermine,
except the agent writing the casualty coverage shall
receive up to thirty-five per cent (35%)of the commission
on such coverage written by him and shall not participate
in the distribution ofthe remaining commission on that
coverage.
Section 5:Repealing Clause:All ordinances orparts of
ordinances inconsistent with the terms of this ordinance are
hereby repealed;provided,however,thatsuch repeal shall be
only to the extent of such inconsistency and in all other re
spects this ordinance shall be cumulative of other ordinances
regulating and governing the subject matter covered bythis
ordinance.

Section 6:Savings Clause:If any provision,section,
exception,subsection,paragraph,sentence,clause or phrase of
this ordinance or the application of same to any person or set of
circumstnaces,shall for any reason be held unconstitutional,
void or invalid,such invalidity shall notaffect the validity of
the remaining provisions of this ordinance are declared to be
severable.
Section 7:Effective Date:This ordinance shall take ef
fect from and after its passage by the City Council of the City
of Baytown.
