AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS,
DECLARING THAT AN EMERGENCY SITUATION EXISTS;AUTHORIZING THE
MAYOR AND.THE CITY CLERK TO EXECUTE AND ATTEST TO A CONTRACT
WITH NAYLOR PTPF CLFANTNfi COMPANYFORTHEREPAIROFASANITARYSEWERLINE;ANDAUTHORIZING THE
CONTRACTING OF INDEBTEDNESS BY THE CITY FOR THE SUM OF
THIRTEEN THOUSAND FIVE HUNDRED FOUR AND 01/100 ($13,504.01)
DOLLARS WITH REGARD TO SUCH AGREEMENT.
WHEREAS,there exists on PearceStreet from First Street to Commerce,andGlen
Street to South Main near Alexander Drive a sanitary sewer line in a present state
of disrepair due to pipe deterioration and resulting cave-ins;and
WHEREAS,said sewer line services a large area and a great number of people;
and
WHEREAS,it is necessary to perserve and protect the public health of the
citizens of the City of Baytown;and
WHEREAS,considering the above,the City Council of the City ofBaytown,deems
that an emergency situation exists;NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OFBAYTOWN,TEXAS:
Section 1:That the City Council of the City of Baytown,Texas,hereby declares
that an emergency situation exists.
Section 2:That the Mayor and City Clerk of the City of Baytown are hereby
authorized and directed to enter into a contract containing the usual performance
and payment bond provisions with NAYLOR PIPE CLEANING COMPANY
for the repairof a sanitary sewer line existing on Pearce Street from First Street
to Commerce,and Glen Street to South Main near Alexander Drive,on a construction
timetable of 5 working days,and authorizes the contracting of indebtedness by
the City of Baytown for the sum of THIRTEEN THnusANn ftvf hundred four ANn m/mn
(S13.504.nn Dollars.
Section 3:That,pursuant tothe provisions of Article 2368a,Section 2a,
Vernon's Annotated Texas Statutes,the City Manager is hereby granted general
authority to approve any change order involving a decrease or an increase in
costs of Five Thousand andNo/100 ($5,000.00)Dollars or less,subject to the
proviso that the original contract price may not be increased by more than
twenty-five (25%)percent or decreased by more than twenty-five (25%)percent
without the consent of the contractor to such decrease.
Section 4:This ordinance shall take effect from and after its passage by
the City Council of the City of Baytown.
